PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 1 March 1999, the applicant was charged with three specifications of absent without leave, one specification of escape from custody and one specification of failure to obey an order. On 11 March 1999, the applicant consulted with legal counsel and voluntarily requested, in writing, discharge under the provisions of Chapter l0, AR 635-200 in lieu of trial by court-martial. In this request, the applicant admitted guilt to the offense, or a lesser-included offense. Further, the applicant indicated that he understood that he could receive an under other than honorable conditions discharge and that the discharge would have a significant effect on eligibility for veteran’s benefits. The applicant submitted a statement in his own behalf. The unit commander and intermediate commanders recommended approval of an under other than honorable conditions discharge. The Staff Judge Advocate recommended approval with an under other than honorable conditions discharge. On 28 March 1999, the separation authority approved the discharge with an under other than honorable conditions discharge. The applicant was to be reduced to the lowest enlisted rank.

         b. On 2 April 1999, the applicant was discharged. At the time of discharge, the applicant had 3 years, 6 months, and 13 days on his current enlistment and
29 days lost time.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l0 of that regulation provides, in pertinent part, that a member who has committed an offense or offenses for which the authorized punishment includes a punitive discharge may submit a request for a discharge for the good of the service in lieu of trial by court-martial. The requests may be submitted at any time after charges have been preferred and must include the individual’s admission of guilt. Army policy states that although an honorable or general discharge is authorized, a discharge UOHC is normally considered appropriate.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

         b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, paragraph l, above:

(7) The issue is accepted. The Board carefully examined the applicant’s record of service during the period of enlistment under review and the documents submitted with his application. While the Board does not condone the applicant’s misconduct, it determined that the characterization of service was inequitable. The evidence of record indicates the applicant was evaluated by a psychiatrist at the 121 st General Hospital, Seoul, Korea, and was found to have an adjustment disorder. The psychiatrist recommended the command consider discharging the applicant under Chapter 5-13, Army Regulation 635-200. The Board found that the applicant’s adjustment disorder, faithful and honorable service, to include his combat service, awards and decorations, and record of promotions, mitigated the discrediting entries in his service record. Accordingly, the Board voted to grant partial relief in the form of an upgrade of characterization of service to general, under honorable conditions. The Board, being convinced that the reason for discharge was proper and equitable, voted not to change it.

(1-6) The issues are rejected. The evidence of record shows the applicant was charged with the commission of offenses punishable under the Uniform Code of Military Justice (UCMJ) with a punitive discharge. The Board noted that, after consulting with defense counsel, the applicant voluntarily, and in writing, requested separation from the Army in lieu of trial by court-martial. In doing so, the applicant admitted guilt to the stipulated offenses under the UCMJ. The Board was satisfied that all requirements of law and regulation were met and the rights of the applicant were fully protected throughout the separation process. It also noted that the characterization of service for this type of discharge is normally under other than honorable conditions and that the applicant was aware of that prior to requesting discharge.
