PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 23 April 1996, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l4, AR 635-200, by reason of misconduct—conviction by a civil court, with an under other than honorable conditions discharge. He was advised of his rights. The applicant acknowledged notification, consulted with legal counsel, was advised of the impact of the discharge action, voluntarily waived consideration of his case by an administrative separation board, contingent upon his receiving a characterization of service or no less favorable than general, under honorable conditions. He did not submit a statement in his own behalf. On 25 April 1997 the applicant through his counsel conditionally waived his rights to an administrative separation board. The unit commander subsequently recommended separation from the Army. The intermediate commander reviewed the proposed discharge action and recommended approval of the separation action with an under other than honorable conditions discharge. On 8 May 1997, the separation authority approved the applicant’s conditional waiver submitted through his counsel and directed that the applicant be discharged with an under other than honorable conditions discharge.

         b. On 25 June 1997, the applicant was discharged. At the time of discharge, the applicant had 1 year, 3 months, and 11 days service on his current enlistment and 2,565 days lost time.

         c. The unit commander recommended the applicant be discharged from the Army because he was convicted in civil court under Greek law for attempted murder, attempted robbery, and indecent assault.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

          a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

 (1) The issue is rejected. The Board carefully examined the applicant’s record of service during the period of enlistment under review, considered the character references submitted with his application, and the comments provided by his counsel. Notwithstanding the applicant’s contention that his misconduct was an isolated incident, the evidence of record indicates the applicant committed many acts of misconduct. His misconduct consisted of assaulting three women by inflicting multiple stab wounds to their bodies, insulting another woman by fondling her buttocks, and using and possessing a forbidden weapon. He was charged, convicted, and sentenced to 23 years and 9 months in a Greek Penitentiary for these crimes, which was later reduced to 14 years and 9 months. The conviction by civil authorities, to include denial of the appeal, obligated military authorities to consider the applicant for discharge. Retention is normally only considered in exceptionally meritorious cases when clearly in the best interests of the Army. Because of the civilian conviction, the applicant diminished the quality of service below that meriting a fully honorable or general discharge. The Board noted that the applicant waived having his case heard by an Administrative Separation Board. The applicant provided no independent corroborating evidence demonstrating that either the command's action was erroneous or that his service mitigated the misconduct. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
