PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 17 April 1992, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l4, AR 635-200, by reason of misconduct, with an under other than honorable conditions discharge. He was advised of his rights. The applicant acknowledged notification, consulted with legal counsel, was advised of the impact of the discharge action, voluntarily waived consideration of his case by an administrative separation board, contingent upon he receiving a characterization or less no favorable than a general, under honorable conditions. He submitted a statement in his own behalf. The unit commander subsequently recommended waiver of further rehabilitative efforts and recommended separation with an under other than honorable conditions discharge. The intermediate commanders reviewed the proposed discharge action, recommended disapproval of the request for the applicant’s conditional waiver and recommended separation action with an under other than honorable conditions discharge. On 10 June 1992, the applicant consulted with legal counsel and voluntarily waived consideration of his case by an administrative separation board. Staff Judge Advocate recommended separation with an under other than honorable conditions discharge. On
11 June 1992, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with an under other than honorable conditions discharge.

         b. On 16 June 1992, the applicant was discharged. At the time of discharge, the applicant had 1 year, 2 months, and 20 days service on his current enlistment.

         c. The unit commander recommended the applicant be separated from the Army because he intentionally violated the uniform code of military justice as well as civil laws by attempting to steal items from at least six vehicles. He was arrested by civil authorities.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

          a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

          b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above:

 (1) The issue is rejected. Even though a single incident, the Board concluded that the discrediting entry constituted a departure from the standards of conduct expected of soldiers in the Army. The applicable Army regulation states that there are circumstances in which the conduct or performance of duty reflected by a single incident provides the basis for a characterization. Having examined all the circumstances, the Board determined that the applicant's single incident of misconduct did indeed adversely affect the quality of service, brings discredit on the Army, and was prejudicial to good order and discipline. This single incident of misconduct clearly diminished the quality of the applicant's service below that meriting a fully honorable or general discharge. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.

(2) and (3) The issues are rejected. The Board carefully examined the applicant’s record of service during the period of enlistment under review. The Board acknowledges the applicant's successful transition to civilian life and noted the accomplishments outlined in his application and/or in the documents with his application. However, in review of the applicant’s entire service record, the Board found that these accomplishments did not overcome the reason for discharge and characterization of service granted. Furthermore, an honorable discharge for subsequent military service does not make the prior service discharge improper. The Board, being convinced that the reason of discharge and the characterization of service were both proper and equitable, voted to deny relief.
