PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 29 October 1986, the applicant was barred to reenlistment. On 2 December 1986, the applicant believing that she was unable to overcome the bar to reenlistment, requested immediate discharge and acknowledged that she understood she would not be permitted to reenlist at a later date. On 6 December 1986, the unit commander reviewed the applicant’s request for discharge, concurred with her request and recommended approval of the discharge action and forwarded it through command channels to the separation authority. On 18 December 1986, the separation authority directed that the applicant be discharged from service under the provisions of Chapter 16, AR 635-200 with an honorable discharge.

         b. On 2 February 1987, the applicant was discharged. She was credited with
2 years, and 8 days active service on the enlistment under review and 7 years,
3 months, and 23 days total time in service.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 16 covers discharges caused by changes in service obligations. Paragraph 16-5 applies to personnel denied reenlistment and provides that soldiers who receive DA imposed or locally imposed bars to reenlistment, and who perceive that they will be unable to overcome the bar may apply for immediate discharge. Incident to the request the member must state that he understands that recoupment of unearned portions of any enlistment or reenlistment bonus is required and that later reenlistment is not permitted. Army policy states that the service of personnel separated under this paragraph will be characterized as honorable.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

         b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above:

(1) The issue is rejected. The Board carefully examined the applicant’s record of service during the period of enlistment under review. The evidence of record shows that the appropriate authority approved the applicant’s discharge under the provisions of Chapter 16, AR 635-200, by reason of Locally Imposed Bar to Reenlistment with an honorable discharge. However, someone involved in the discharge process erroneously assigned a Reenlistment (RE) code of RE-4. Army Regulation 635-5-1, in effect at the time of discharge, shows that a RE-3 is the appropriate RE code for a soldier being discharge under the provisions of chapter 16 with less than 18 years of active service. Accordingly, the Board directs an administrative correction of the RE code on the applicant’s DD Form 214 from “RE code 4 to RE code 3.” The Board being convinced that the approved reason for discharge and characterization of service were both proper and equitable, voted to deny relief.
