PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 24 February 1992, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l4, AR 635-200, by reason of misconduct—pattern of misconduct, with a general discharge. He was advised of his rights. The applicant consulted with legal counsel, was advised of the impact of the discharge action, requested a hearing by an administrative separation board and did not submit a statement in his own behalf. The unit commander subsequently recommended separation from the service, and waiver of further rehabilitative efforts. The intermediate commander reviewed the proposed discharge action and recommended approval of the separation action with a general discharge. On 25 March 1992, the applicant was notified to appear before a board of officers. On 16 April 1992, the board of officers met; applicant appeared with counsel. The board recommended separation for misconduct with issuance of a general discharge. On 5 May 1992, the separation authority approved the findings and recommendations of the board and directed that the applicant be discharged with a general discharge.

         b. On 14 May 1992, the applicant was discharged. At the time of discharge, the applicant had 2 years, 5 months, and 2 days, service on his current enlistment under review and 7 years, 2 months and 18 days, total time in service.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

          a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

 (1-9) The issues are rejected. The Board carefully examined the applicant’s record of service during the period of enlistment under review and heard his testimony. There was a full consideration of all faithful and honorable service as well as infractions of discipline, the extent thereof, and the seriousness of the offenses. The Board noted the applicant’s contentions. However, they are not supported by either the evidence submitted with his application or the evidence of record. The evidence of record shows that the applicant accumulated the following: numerous counseling statements for indebtedness and misconduct; a bar to reenlistment for indebtedness and misconduct; and a special court-martial conviction for failure to repair and disrespect to a noncommissioned officer. Additionally, the evidence of record shows that the applicant, represented by counsel, appeared before an administrative separation board that found the applicant undesirable for retention in military service and recommended that he be discharged under the provisions of Chapter 14, AR 635-200, by reason of a pattern of misconduct and that he be issued a general, under honorable conditions characterization of service. The Board determined that the discrediting entries in the applicant's record were not outweighed by prior or subsequent service of sufficient merit to warrant an upgrade of the discharge being reviewed. Further, the Board concluded that the applicant had many legitimate avenues through which to obtain assistance or relief, without committing the misconduct, which led to the separation action under review. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
