PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

          a. The evidence of record shows that on 5 July 1994, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter 11, AR 635-200 by reason of entry level status performance and conduct, with an uncharacterized discharge. He was advised of his rights. The applicant waived legal counsel, was advised of the impact of the discharge action, and submitted a statement in his own behalf. The unit commander subsequently recommended approval of the discharge action and forwarded it through command channels to the separation authority. On 11 July 1994, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with an uncharacterized discharge.

         b. On 14 July 1994, the applicant was discharged. He was credited with
3 months and 20 days of active service on the enlistment under review.

         c. The unit commander recommended the applicant be separated from the Army because he had not achieved the level of physical fitness required for him to graduate. The applicant failed every diagnostic Army Physical Fitness Test (APFT) and was counseled numerous times for these failings. His progress just was not commensurate with the week of training his unit was in.

 2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 11, of this regulation, in effect at the time, provided, for the separation of personnel due to unsatisfactory performance, conduct, or both, while in an entry level status. This provision of regulation applied to individuals who had demonstrated that they were not qualified for retention because they could not adapt socially or emotionally to military life, or because they lacked the aptitude, ability, motivation or self discipline for military service, or that they had demonstrated characteristics not compatible with satisfactory continued service. The separation policy applies to soldiers who cannot meet the minimum standards prescribed for successful completion of training because of lack of aptitude, ability, motivation or self-discipline. The regulation requires uncharacterized service for separation under this chapter.

          a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

 (1) The issue is rejected. The Board carefully examined the applicant’s record of service during the period of enlistment under review and the letters/documents submitted with his application. The Board noted the applicant’s contention, in effect, that he wants his discharge upgraded to honorable in order to join the Michigan State Police. The evidence of record shows that the applicant was discharged under the provisions of chapter 11, AR 635-200 for entry-level performance and conduct with an uncharacterized separation while in an entry-level status. Any individual who has served for less than l80 days at the time his or her commander initiated separation action, and is not being separated for serious misconduct, will be given an uncharacterized discharge. The purpose of the entry-level status is to provide the soldier a probationary period. Based on the evidence of record, the applicant was separated solely as a result of his failing the Army Physical Fitness Test (APFT). While he showed constant improvement through basic training and advanced individual training, he was unable to satisfactorily pass the APFT and was subsequently discharged. A fully honorable discharge may be granted only in cases that are clearly warranted by unusual circumstances involving outstanding personal conduct and/or performance of duty. The Board determined that no such unusual circumstances were present in the applicant’s record and his service did not warrant an honorable discharge. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
