SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. On 1 September 1999, the applicant was charged with wrongful possession of 13 grams of hashish. On 21 October 1999, PERSCOM Message stated that the applicant’s resignation for the good of the service was approved, and directed issuance of a general, under honorable conditions discharge.

         b. On 5 November 1999, the applicant was discharged. At the time of discharge, the applicant had 2 years, 8 months, and 2 days, active military service for the term of service under review.

Legal/Regulatory Basis for Separation Action : Army regulation 600-8-24 prescribes the policies and procedures governing the transfer and discharge of Army officer personnel. Chapter 3, Paragraph 3-13 outlines the rules for processing request for resignation for the good of the service in lieu of trial by a general court-martial.

(1) The issue is rejected. The Board carefully reviewed the applicant’s record during the period of service under review. There was a full consideration of all his faithful and honorable service as well as the infraction of discipline, the extent thereof, and the seriousness of the offense. The evidence of record shows that the applicant was charged with the commission of an offense punishable under the Uniform Code of Military Justice with a punitive discharge. The applicant voluntarily requested resignation in lieu of trial by general court-martial under the provisions of Chapter 3, AR 600-8-24. The appropriate authority approved the applicant's request and issuance of a general, under honorable conditions discharge. The Board concluded that by his misconduct, the applicant diminished the overall quality of his service below that meriting a fully honorable discharge. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
