PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 28 February 1990, the applicant acknowledged receipt of his discharge packet under the provisions of Chapter l4, AR 635-200. On 28 February 1990, Orders 39-11, DA, US Army Garrison, Fort Sheridan, IL, discharged the applicant from the Army, effective date:
8 March 1990. The applicant was available to sign his DD Form 214 (Certificate of Release or Discharge from Active Duty). His DD Form 214 indicates that he was discharged under the provisions of Chapter 14, Paragraph 14-12c, AR 635-200 by reason of misconduct-commission of a serious offense with a characterization of service of under other than honorable conditions. Furthermore, the DD Form 214 shows a Separation Code of JKQ (i.e., misconduct - commission of a serious offense). The specific facts and circumstances leading to the applicant’s discharge are not available records.

         b. On 8 March 1990, the applicant was discharged. At the time of discharge, the applicant had 2 years, 6 months, and 11 days service on his current enlistment and 12 years, 7 months, and 12 days total time in service.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

(1) The issue is rejected. The Board carefully examined the applicant’s record of service during the period of enlistment under review. The Board noted that the facts and circumstances regarding the applicant’s separation were not in the file. However, the record contains a properly constituted DD Form 214 (Certificate of Release or Discharge From Active Duty) which was authenticated by the applicant’s signature. That DD Form 214 indicates that the applicant was discharged under the provisions of Chapter 14, AR 635-200, by reason of misconduct – commission of a serious offense with a characterization of service of under other than honorable conditions. The Board noted the applicant’s contention that his discharge was inequitable because it was based on an isolated incident. Absence evidence to the contrary, the Board presumes administrative regularity in the processing of the applicant’s discharge. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
