PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 21 July 1992, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l4, AR 635-200, by reason of misconduct—commission of a serious offense, with a general, under honorable conditions discharge. He was advised of his rights. The applicant acknowledged notification, consulted with legal counsel, was advised of the impact of the discharge action, and voluntarily waived consideration of his case by an administrative separation board contingent upon his receiving a characterization of service no less favorable that general, under honorable conditions. He did not submit a statement in his own behalf. The unit commander subsequently recommended waiver of further rehabilitative efforts and recommended separation with a general, under honorable conditions discharge. The intermediate commander reviewed the proposed discharge action and recommended approval of the separation action with a general, under honorable conditions discharge. On 23 July 1992, the separation authority directed that the applicant be discharged with a general, under honorable conditions discharge.

         b. On 3 August 1992, the applicant was discharged. At the time of discharge, the applicant had 2 years, 10 months, and 5 days service on his current enlistment and 6 years, 8 months, and 1 day total time in service.


         c. The unit commander recommended the applicant be separated from the Army because he was charged with driving under the influence of alcohol. His BAC was .116%.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

 (1), (2), and (3) The issues are rejected. The Board carefully examined the applicant’s record of service during the period of enlistment under review. The record does not support the applicant’s contention, and no evidence to support it has been submitted by the applicant, that he had inadequate counsel. The Board noted the applicant consulted with legal counsel and then voluntarily, and in writing, waived consideration of his case by an administrative separation board contingent upon his receiving a characterization of service no less favorable than general, under honorable conditions. He did not submit a statement in his own behalf. The Board found no evidence of arbitrary or capricious actions by the command. The Board was satisfied that all requirements of law and regulation were met and the rights of the applicant were fully protected throughout the separation process. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.

          b. Equity:       The applicant has not submitted an issue of equity and the ADRB has not otherwise relied upon an issue of equity to change the discharge. The major factors upon which the discharge was based are set forth in Parts III and IV of this decisional document.
