PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 22 July 1992, the unit commander recommended the applicant be separated with a general, under honorable conditions discharge. The specific facts and circumstances leading to the applicant’s discharge are not contained in the available records. However, On 29 July 1992, Orders 211-29, DA, US Army Transportation Center, Fort Eustis, VA, released the applicant from the Regular Army, effective 4 August 1992. The applicant’s DD Form 214 (Certificate of Release or Discharge from Active Duty) indicates that he was released from active duty under the provisions of Chapter 13, Paragraph 13-2, AR 635-200 by reason of unsatisfactory performance with a characterization of service of general, under honorable conditions.

         b. On 4 August 1992, the applicant was discharged. At the time of discharge, the applicant had 7 months and 23 days on his current enlistment and
3 years, 7 months, and 5 days total time in service.

         c. The unit commander recommended the applicant be separated due to his being counseled for financial delinquency, failure to repair, and misuse of government telephone. He further declared the applicant had demonstrated he is a substandard soldier with no motivation to work with the chain of command to become a productive soldier.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 13 contains the policy and outlines the procedures for separating individuals for unsatisfactory performance, and provides, in pertinent part, that commanders will separate a member under this chapter when, in the commander's judgment, the member will not develop sufficiently to participate satisfactorily in further training and/or become a satisfactory soldier. Army policy states that a general discharge, under honorable conditions is normally considered appropriate, but an honorable discharge may be granted in meritorious cases.

          a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

 (6) The issue is accepted. The Board carefully considered the applicant’s testimony before the Board and his overall service record. There was a full consideration of all service including the infractions of discipline, the extent thereof, and the seriousness of the offenses. While the applicant’s misconduct was a clear departure from acceptable Army standards, the Board found that the nature of the offenses and the length and quality of his service mitigated the misconduct. In view of the foregoing, the Board determined that the characterization of service was inequitable. Accordingly, the Board voted to grant relief in the form of an upgrade of characterization of service to honorable. The Board determined that the reason for discharge was proper and equitable and voted not to change it.
