PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 25 March 1999, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l4, AR 635-200, by reason of misconduct—commission of a serious offense, with an honorable discharge. He was advised of his rights. On 11 May 1999, the applicant acknowledged notification, consulted with legal counsel, and was advised of the impact of the discharge action. He voluntarily waived consideration of his case by an administrative separation board contingent upon his receiving a characterization of service no less favorable than honorable and did not submit a statement in his own behalf. On 11 May 1999, the unit commander subsequently recommended separation from the service, and waiver of further rehabilitative efforts. The applicant was notified to appear before a board of offices and advised of his rights. The board’s findings and recommendation are not in file. On 20 June 1999, the separation authority directed that the applicant be discharged with a general discharge.

         b. On 23 July 1999, the applicant was discharged. At the time of discharge, the applicant had 1 year, 4 months, and 12 days service on his current enlistment and 11 years, 9 months, and 25 days total time in service.

         c. The unit commander recommended the applicant be discharged from the Army because he assaulted a 16 year old female student summer hire employee by unwelcome physical contact by placing his arm on her and kissing her on the cheek and/or side of her face. He also obtained services under false pretenses by utilizing his government LCR card for making $253.35 in personal long distance telephone calls and mailing personal correspondence utilizing official military mail channels.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

(2) The issue is accepted. The Board carefully examined the applicant’s record of service during the period of enlistment under review. There was a full consideration of all faithful and honorable service, and the infractions of discipline, which led to his separation from the Army. While the Board does not condone the applicant’s misconduct, it determined that the characterization of service was inequitable. The Board found that the length and quality of the applicant’s service mitigated his misconduct. Accordingly, the Board voted to grant relief in the form of an upgrade of characterization of service to fully honorable. The Board determined that the reason for discharge was proper and equitable and voted not to change it.
