PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 1 June 1992, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l4, AR 635-200, by reason of misconduct—commission of a serious offense, with an under other than honorable conditions discharge. The applicant acknowledged notification, consulted with legal counsel, was advised of the impact of the discharge action, voluntarily waived consideration of his case by a board of officers contingent upon his receiving no less favorable than a general, under honorable conditions discharge and did not submit a statement on his own behalf. The unit commander subsequently recommended separation with an under other than honorable conditions discharge. The intermediate commander reviewed the proposed discharge action and recommended approval of the separation action with a general, under honorable conditions discharge. On 12 June 1992, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with a general discharge.

         b. On 21 July 1992, the applicant was discharged with a general, under honorable conditions discharge. At the time of discharge, the applicant had
3 years, 10 months, and 14 days service on his current enlistment.

         c. The Board noted that the DD Form 214 contains an administrative error in Block 12b regarding the applicant’s separation date.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

(1), (2), and (3) The issues are rejected. The Board carefully reviewed the applicant’s record of service during the period of enlistment under review. There was a full consideration of all faithful and honorable service as well as infractions of discipline, the extent thereof, and the seriousness of the offenses. The Board noted the applicant’s contention that his discharge was inequitable because it was based on one isolated incident. Notwithstanding the applicant’s contention, the Board concluded that the applicant’s record supports his being discharged by reason of misconduct. While he was discharged for the use of illegal drugs on two occasions, the record also shows that the applicant failed to report for formations on several occasions, failed to follow orders, failed to report to physical training formations and was insubordinate to noncommissioned officers. In addition, the applicant went AWOL for 46 days just prior to separation from the Army for misconduct. The Board determined that the applicant's discharge was appropriate because the quality of service was not consistent with the Army's standards for soldiers. Further, the applicant had the duty to support and abide by the Army's drug policies. By abusing illegal drugs, the applicant knowingly risked a military career and diminished the quality of service below that meriting a fully honorable discharge. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
