PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 15 April 1987, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l3, AR 635-200, by reason of unsatisfactory performance, with an honorable discharge. He was advised of his rights. On 28 April 1987, the applicant consulted with legal counsel, was advised of the impact of the discharge action, and voluntarily waived consideration of his case by an administrative separation board contingent upon his receiving a characterization of service no less favorable than an honorable discharge. He did not submit a statement in his own behalf. The unit commander subsequently recommended separation from the service and waiver of further rehabilitative efforts. On 19 May 1987, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with an honorable discharge.

         b. On 15 July 1987, the applicant was discharged. At the time of discharge, the applicant had 5 years, 4 months, and 25 days service on his current enlistment and 12 days of lost time. He had 7 years, 10 months, and 13 days total time in service.

         c. The unit commander recommended the applicant be separated from the Army due to his repeatedly writing dishonored checks.

2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 13 contains the policy and outlines the procedures for separating individuals for unsatisfactory performance, and provides, in pertinent part, that commanders will separate a member under this chapter when, in the commander's judgment, the member will not develop sufficiently to participate satisfactorily in further training and/or become a satisfactory soldier. Army policy states that a general discharge, under honorable conditions is normally considered appropriate, but an honorable discharge may be granted in meritorious cases.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

         b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above:

(1) The issue is rejected. The Board carefully considered the applicant’s testimony before the Board, additional documents, and his record of service during the period of enlistment under review. The applicant requested that blocks 26 (Separation Code) and 28 (Narrative Reason for Separation) of his DD Form 214 (Certificate of Release or Discharge from Active Duty) be changed so that he may serve in the Active Guard Reserve. Based on the evidence of record, the applicant was found guilty by special court martial on 830713 on three specifications of defraud by check and was sentenced to confinement at hard labor for three months and reduction to E1. The Board noted that the applicant returned to his active military status following his confinement and quickly reestablished his position and rank. However, the record further shows that the applicant continued to have unpaid debts and on 17 March 1987 had amassed 29 dishonored checks totaling $2,934.60 over a two month period. On 15 April 1987, the applicant’s unit commander initiated separation action for repeatedly writing dishonored checks. The Board noted the applicant's record of service as a member of the Army National Guard over the last eight years and compliments him on his performance and progress. However, the Board did not find that this service mitigated the misconduct which lead to his separation for the period under review. The Board, being convinced that the narrative reason for separation and the separation code were both proper and equitable, voted to deny relief.
