PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 4 October 1988, the unit commander in consultation with the Clinical Director/ADAPCP declared the applicant a rehabilitation failure. On 14 November 1988, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter 9, AR 635-200, by reason of drug abuse rehabilitation failure, with a general discharge. He was advised of his rights. The applicant consulted with legal counsel, was advised of the impact of the discharge action, declined treatment in a VA medical center, and submitted a statement in his behalf. The unit commander subsequently recommended separation from the service, and waiver of further rehabilitative efforts. On 15 November 1988, the CPT, JA Senior Defense Counsel recommended that the separation action be disapproved for legal insufficiency. On 22 November 1988, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with a general discharge.

         b. On 8 December 1988, the applicant was discharged with a general discharge. At the time of discharge, the applicant had 2 years, 3 months, and
24 days service on his current enlistment.

2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 9 contains the authority and outlines the procedures for discharging individuals because of alcohol or other drug abuse. A member who has been referred to the Alcohol and Drug Abuse Prevention and Control Program (ADAPCP) for alcohol/drug abuse may be separated because of inability or refusal to participate in, cooperate in, or successfully complete such a program if there is a lack of potential for continued Army service and rehabilitation efforts are no longer practical. Army policy states that an honorable or general discharge is authorized depending on the applicant’s overall record of service. (However, an honorable discharge is required if restricted use information is used in the discharge process).

 (2) The issue is accepted. The applicant was discharged under the provisions of Chapter 9, AR 635-200, as a drug abuse rehabilitation failure. However, at the time of his discharge, the applicant was not enrolled in the ADAPCP program. As such, he was improperly discharged under the provisions of Chapter 9. Accordingly, the Board voted to change the narrative reason for discharge to Secretarial Authority and the characterization of service to fully honorable.
