PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 28 May 1998, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l3, AR 635-200, by reason of unsatisfactory performance, with a general discharge. He was advised of his rights. The applicant consulted with legal counsel, was advised of the impact of the discharge action, and did not submit a statement in his behalf. The unit commander subsequently recommended separation from the service, and waiver of further rehabilitative efforts. On undated, the separation authority waived further rehabilitative efforts and directed that the applicant be transferred to the individual Ready Reserve with service characterized as general.

         b. On 1 July 1998, the applicant was released from active duty with a general discharge. At the time of discharge, the applicant had 1 year, 8 months, and 15 days service on his current enlistment and 5 years, 5 months and 24 days total time in service.

         c. The unit commander indicated that his specific reasons for initiating the applicant’s discharge were the following: failure to obey lawful orders from superior commissioned officers; disrespect towards superior noncommissioned officers; and, dereliction of duties.

2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 13 contains the policy and outlines the procedures for separating individuals for unsatisfactory performance, and provides, in pertinent part, that commanders will separate a member under this chapter when, in the commander's judgment, the member will not develop sufficiently to participate satisfactorily in further training and/or become a satisfactory soldier. Army policy states that a general discharge, under honorable conditions is normally considered appropriate, but an honorable discharge may be granted in meritorious cases.

          a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

 (1) and (2) The issues are rejected. The Board carefully reviewed the applicant’s record of service during the period of enlistment under review. The Board noted the applicant’s contention that he served honorably and that his misconduct of record was a result of marital problems. However, the record indicates that the applicant demonstrated disrespect towards officers and noncommissioned officers, failed to follow lawful commands, and was derelict in his duties as a noncommissioned officer. The applicant also indicates in his statement of issues that he voluntarily sought separation from the service through misconduct. Notwithstanding the applicant’s marital problems, the Board found sufficient misconduct and substandard performance to warrant the separation action under review. The applicant's discharge was appropriate because the quality of service was not consistent with the Army's standards for acceptable personal conduct and performance of duty by military personnel. The applicant provided no independent corroborating evidence demonstrating that either the command’s action was erroneous or that the applicant’s service mitigated the misconduct. Before initiating action to separate the applicant, the command ensured the applicant was appropriately counseled about the deficiencies which could lead to separation. The Board noted that the command made an assessment thereafter of the applicant's potential for becoming a fully satisfactory soldier, and the command appropriately determined the applicant did not demonstrate the potential for further military service. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
