PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 10 July 1984, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l4, AR 635-200, by reason of misconduct—patterns of misconduct. He was advised of his rights. The applicant consulted with legal counsel, was advised of the impact of the discharge action, requested a hearing by a board of officers and did not submit a statement in his behalf. The unit commander recommended separation from the Service. The intermediate commanders reviewed the proposed discharge action and recommended approval of the separation action with an under other than honorable conditions discharge. On 14 September 1984, board of officers met; applicant appeared with legal counsel. The board recommended separation for misconduct-drug abuse with a characterization of under other than honorable conditions discharge. On 2 October 1984, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged under the provisions of Paragraph 14-12d, Chapter 14, of AR 635-200, for misconduct-drug abuse, with an under other than honorable conditions discharge.

         b. On 15 October 1984, the applicant was discharged with an under other than honorable conditions discharge. At the time of discharge, the applicant had
1 year, 5 months, and 28 days service on his current enlistment and 4 years,
2 months and 23 days total time in service.

2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.


         b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

(1) The issue is accepted in part. There was a full consideration of all service including the infractions of discipline, the extent thereof, and the seriousness of the offenses. The Board determined that the characterization of service was inequitable because the quality of the applicant's service did not warrant the granting of an under other than honorable conditions discharge. The applicant's failure to perform in accordance with Army standards was mitigated by service of sufficient merit to warrant an upgrade of the discharge being reviewed. Accordingly, the Board voted to grant partial relief in the form of an upgrade of characterization of service to general, under honorable conditions.

(2) and (3) The issues are rejected. The Board noted the applicant’s contentions that, in effect, his post service conduct has been excellent; and that he did not understand the seriousness of his actions at the time of his discharge. However, after carefully examining the applicant’s record of service for the period of enlistment under review, the Board determined that the reason for the applicant’s discharge was appropriate, and that his misconduct clearly diminished the quality of his service below that meriting a fully honorable discharge. The Board found no evidence of arbitrary or capricious actions by the command. The Board was satisfied that all requirements of law and regulation were met and the rights of the applicant were fully protected throughout the separation process. Therefore, the Board determined that relief beyond that already provided in response to issue (1) above is not warranted. Finally, the Board concluded that the reason for discharge was proper and equitable and voted not to change it, and that relief.
