PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 2 October 1986, a court-martial charge was preferred against the applicant for six specifications of failure to go to his prescribed place of duty (FTG) (851206); (860109); (860123); (860124); (860426); (860508); and for willfully disobeying a lawful order (851204. On
24 November 1986, the applicant consulted with legal counsel and voluntarily requested, in writing, discharge under the provisions of Chapter l0, AR 635-200 for the good of the Service. In this request, the applicant admitted guilt to the offense, or a lesser included offense. Further, the applicant stated that he understood that he could receive an under other than honorable conditions (UOHC) discharge and that the discharge would have a significant effect on eligibility for veteran’s benefits. The applicant submitted a statement on his own behalf. The unit commander and intermediate commanders recommended approval of the applicant’s request for separation with a UOHC discharge. On 5 December 1986, the separation authority approved the applicant’s request for separation and directed that he receive a UOHC discharge and that he be reduced to the lowest enlisted rank.

         b. On 31 December 1986, the applicant was discharged with a UOHC discharge. At the time of discharge, the applicant had completed 3 years and 9 months of his current enlistment, and a total of 7 years and 28 days of active military service.

         c. The applicant’s record shows that he completed over 7 years of service; attained the rank of spcialist/E-4; and earned a Good Conduct Medal. His disciplinary record, for the period of service under review, includes his acceptance of two Article 15’s, both of which included reductions to private first class/E-3. Court-Martial charges were preferred against the applicant, and after consulting with counsel, he voluntarily requested an administrative separation in order to avoid prosecution and the punitive discharge which may have resulted.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l0 of that regulation provides, in pertinent part, that a member who has committed an offense or offenses for which the authorized punishment includes a punitive discharge may submit a request for a discharge for the good of the service in lieu of trial by court-martial. The requests may be submitted at any time after charges have been preferred and must include the individual’s admission of guilt. Army policy states that although an honorable or general discharge is authorized, a discharge UOHC is normally considered appropriate.
