PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 11 October 1989, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l4, AR 635-200, by reason of misconduct—pattern of misconduct. He was advised of his rights. The applicant acknowledged, consulted with legal counsel, was advised of the impact of the discharge action, waived consideration of my case by a board of officers contingent upon my receiving a discharge characterization no less favorable than general and did not submit a statement on his behalf. The unit commander subsequently recommended separation with a general (GD) discharge. The intermediate commander reviewed the proposed discharge action and recommended approval of the separation action with a GD. On 16 October 1989, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with a GD.

         b. On 20 October 1989, the applicant was discharged with a general, under honorable conditions discharge. At the time of discharge, the applicant had
5 years, and 27 days service on his current enlistment and 10 years, 1 month and 18 days total time in service.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

          a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

 (1) The issue is rejected. The Board carefully examined the applicant's record of service during the period of enlistment under review. There was a full consideration of all faithful and honorable service as well as infractions of discipline, the extent thereof, and the seriousness of the offenses. However, the Board concluded that the applicant's discharge was appropriate because the quality of his service was not consistent with the Army's standards for acceptable personal conduct and performance of duty by military personnel. The applicant provided no independent corroborating evidence demonstrating that either the command's action was erroneous or that the applicant’s service mitigated the misconduct or poor duty performance. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.

(2) and (3) The issues are rejected. Corrections to the applicant's DD Form 214 other than those associated with the authority for; narrative reason for; and characterization of discharge; are not in the purview of the Army Discharge Review Board. The applicant can apply to the Army Board for Correction of Military Records using the DD Form 149 enclosed with this response. Further, the Board does not grant relief solely for the purpose of gaining employment or enhancing employment opportunities.
