PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 24 August 1990, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l3, AR 635-200, by reason of unsatisfactory performance, with a recommendation for a general, under honorable conditions discharge (GD). The applicant was advised of his rights, consulted with legal counsel, was advised of the impact of the discharge action, and submitted a statement in his own behalf. The intermediate commander reviewed the proposed discharge action and recommended approval with a GD. On 30 August 1990, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with a GD.

         b. On 6 September 1990, the applicant was discharged with a GD. At the time of discharge, the applicant had completed 1 year, 4 months, and 10 days of active military service.

         c. The applicant’s record shows that he completed almost 1 and ½ years of service and the highest rank he attained while on active duty was private first class/E-3. There are no documented acts of valor, significant achievement, or service warranting special recognition. The applicant’s unit commander processed the applicant for separation for unsatisfactory performance based on the applicant’s inability to perform his duties based on subjective back pain which was unsupported by medical diagnosis. The unit commander further commented that the applicant had failed to respond to all attempts at making him a useful soldier. The evidence of record does contain a report of medical examination in which competent medical authority found the applicant fit for duty and cleared him for retention/separation. The clinical evaluation portion of the medical examination found the applicant’s back condition normal and the remarks section indicates that although the applicant had complained of chronic lower back pain, he had been evaluated and cleared for separation the orthopedic section. The physical profile awarded the applicant in his separation physical examination was A/111111, indicating he suffered from no disqualifying medical condition at the time of his discharge.

2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 13 contains the policy and outlines the procedures for separating individuals for unsatisfactory performance, and provides, in pertinent part, that commanders will separate a member under this chapter when, in the commander's judgment, the member will not develop sufficiently to participate satisfactorily in further training and/or become a satisfactory soldier. Army policy states that a general discharge, under honorable conditions is normally considered appropriate, but an honorable discharge may be granted in meritorious cases.

(2) The issue is accepted. There was a full consideration of all service including the level of the applicant’s poor duty performance as defined by the unit commander in his separation action. The Board determined that the characterization of service was inequitable because the applicant's generally acceptable personal conduct mitigated the documented poor duty performance in the service record. Accordingly, the Board voted to grant relief in the form of an upgrade of characterization of service to fully honorable. The Board determined that the reason for discharge was proper and equitable and voted not to change it.
