PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 16 August 1993, Orders 82-4, DA, HQ, Sierra Army Depot, CA, reassigned the applicant to the US Army transition point for transition processing. After transition processing the applicant was released from active duty and assigned to the US Army Reserve Control Group, Saint Louis, Missouri. The applicant signed DD Form 214, authenticating he was released from active duty with a general discharge for unsatisfactory performance.

         b. On 23 August 1993, the applicant was discharged with a general, under honorable conditions discharge, under the provisions of Chapter l3, AR 635-200, by reason of unsatisfactory performance. At the time of discharge, the applicant had 1 year, 1 month, and 17 days on his current enlistment.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 13 contains the policy and outlines the procedures for separating individuals for unsatisfactory performance, and provides, in pertinent part, that commanders will separate a member under this chapter when, in the commander's judgment, the member will not develop sufficiently to participate satisfactorily in further training and/or become a satisfactory soldier. Army policy states that a general discharge, under honorable conditions is normally considered appropriate, but an honorable discharge may be granted in meritorious cases.

          a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

 (1), (2), (3), and (4) The issues are rejected. The Board carefully examined the applicant’s record of service during the period of enlistment under review. The Board noted that the available record is void of the specific facts and circumstances concerning the events that led to the applicant’s discharge from the Army. The Board also noted that the applicant’s record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty) which was authenticated by the applicant. This document identifies the reason and characterization of the discharge and the Board presumed government regularity in the discharge process. The Board, being convinced that the reason for discharge and the characterization of service were proper and equitable, voted to deny relief.
(5) The issue is rejected. The Board congratulates the applicant on his personal and work achievements since departing the Army. However, the Board does not grant relief solely for the purpose of gaining employment or enhancing employment opportunities.
