PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 18 May 1992, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l3, AR 635 200, by reason of unsatisfactory performance, with a general, under honorable conditions discharge (GD). The applicant was advised of his rights, waived legal counsel, was advised of the impact of the discharge action, and elected not to submit a statement in his own behalf. The unit commander subsequently recommended waiver of further rehabilitative efforts. On 18 May 1992, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with a GD.

         b. On 22 May 1992, the applicant was discharged with a GD. At the time of discharge, the applicant had completed 3 years, 0 months, and 29 days of active military service.

         c. The applicant’s record reflects that he completed just over 3 years of service; attained the rank specialist/E-4; and that he completed an overseas tour in Germany. There are no documented acts of valor, significant achievement, or service warranting special recognition contained in the record. However, the record contains an extensive recorded history of disciplinary infractions, primarily related but not limited to financial/indebtedness infractions. On
18 February 1992 a bar to reenlistment was imposed on the applicant; citing five specific incidents of indebtedness which included writing bad checks. The unit commander also listed an Article 15 for missing formation and a letter of reprimand as other relevant indicators of unsuitability. The unit commander processed the applicant for separation by reason of unsatisfactory performance, citing the disciplinary infractions outlined in the bar to reenlistment as the basis for taking the action.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 13 contains the policy and outlines the procedures for separating individuals for unsatisfactory performance, and provides, in pertinent part, that commanders will separate a member under this chapter when, in the commander's judgment, the member will not develop sufficiently to participate satisfactorily in further training and/or become a satisfactory soldier. Army policy states that a general discharge, under honorable conditions is normally considered appropriate, but an honorable discharge may be granted in meritorious cases.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.


         b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

(1) The issue is rejected. The Board noted the applicant’s contention that, in effect, he deserved an honorable discharge for completing his initial enlistment because his extension of service was for the convenience of the government; and that this would allow him to receive the education benefits he contributed to. However, the evidence of record shows the applicant voluntarily extended his period of service in order to obtain an assignment option to Europe. The applicant provided no independent corroborating evidence demonstrating that either the command's action was erroneous or that his service mitigated the misconduct or poor duty performance. Therefore, the Board concluded that applicant’s discharge was appropriate because his misconduct clearly diminished the quality of his service below that meriting a fully honorable discharge. Furthermore, eligibility for veteran's benefits, to include educational benefits under the Montgomery GI Bill, does not fall within the purview of the Army Discharge Review Board. Accordingly, the applicant should contact a local office of the Department of Veterans Affairs for further assistance. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.

The Board determined that the characterization of service was inequitable because the applicant's generally acceptable personal conduct and performance of duty mitigated his misconduct. Accordingly, the Board voted to grant relief in the form of an upgrade of characterization of service to fully honorable. The Board determined that the reason for discharge was proper and equitable and voted not to change it.
