PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 1 April 1998 a court-martial charge for violation of Article 86 of the UCMJ was preferred against the applicant for a period of AWOL from 1 to 30 March 1998. The applicant’s request for separation, in lieu of trial by court-martial, is not contained in the available records; however, there is a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty) which documents the following: Authority for Separation-Chapter 10, AR 635-200; Narrative Reason for Separation-In Lieu of Trial by Court-Martial; and Character of Service-Under Other than Honorable Conditions (UOHC).

         b. The DD Form 214 also shows that the applicant was discharged on
29 October 1998, with a UOHC discharge. At the time of discharge, the applicant had completed 3 years, 7 months, and 8 days of active military service and had accrued 30 days of time lost due to AWOL.

         c. The applicant’s record shows that she completed almost four (4) years of service; the highest rank she attained while on active duty was specialist/
E-4; and that she earned an Army Achievement Medal. There are no documented acts of valor or other special recognition contained in the record. There is a recorded disciplinary record which includes extensive performance and conduct related counseling and a bar to reenlistment certificate. The applicant was barred from reenlistment on 23 January 1998. The unit commander cited the applicant’s lack of motivation, sporadic mood swings, negative attitude, failure to follow instructions, and disrespect as the basis for taking the action. The record is also clear that the applicant voluntarily requested an administrative separation in order to avoid prosecution and the punitive discharge which may have resulted.

2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 10 of that regulation provides, in pertinent part, that a member who has committed an offense or offenses for which the authorized punishment includes a punitive discharge may submit a request for discharge for the good of the service in lieu of trial by court-martial. The request may be submitted at any time after charges have been preferred and must include the individual's admission of guilt. Army policy states that although an honorable or general discharge is authorized, a discharge UOHC is normally considered appropriate.

(1) and (2) The issues are rejected. The available records do not contain the entire separation packet on the applicant. However, the applicant’s record does contain a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty). This document identifies the reason and characterization of the discharge and the Board presumed Government regularity in the discharge process. The evidence of record shows the applicant was discharged under the provisions of Chapter 10, AR 635-200, for the good of the service in lieu of trial by court-martial. In connection with such a discharge, the applicant was charged with the commission of an offense punishable under the Uniform Code of Military Justice (UCMJ) with a punitive discharge. Procedurally, the applicant was required to consult with defense counsel, and to voluntarily, and in writing, request separation from the Army in lieu of trial by court-martial. In doing so, the applicant admitted guilt to the stipulated offenses under the UCMJ. In the absence of information to the contrary, the Board was satisfied that all requirements of law and regulation were met and the rights of the applicant were fully protected throughout the separation process. It also noted that the characterization of service for this type of discharge is normally under other than honorable conditions and that the applicant was aware of that prior to requesting discharge. Finally, the Board considered entire record of service for the period under review. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
