PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. While the separation packet pertaining to applicant’s discharge proceedings is not on file, there is evidence to suggest that the applicant was discharged under the provisions of Chapter 11, AR 635-200 by reason of the entry level performance and conduct.

         b. The record contains a DD Form 214 (Certificate of Release or Discharge from Active Duty) which documents that the applicant was discharged on 5 May 1983 after completing just 1 month, and 5 days of active military service.

         c. There is a substantial lack of available records on which to evaluate the merits of the applicant’s case. The record does indicate that the applicant was discharged with an uncharacterized description of service based on being in an entry level status. There are no available records on which to determine if the applicant suffered from a service connected disability at the time he was discharged and neither does the independent evidence submitted by the applicant support this contention. The indications are that the applicant was separated because his performance and conduct while in an entry level status was unsatisfactory.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 11, of this regulation, in effect at the time, provided, for the separation of personnel due to unsatisfactory performance, conduct, or both, while in an entry level status. This provision of regulation applied to individuals who had demonstrated that they were not qualified for retention because they could not adapt socially or emotionally to military life, or because they lacked the aptitude, ability, motivation or self discipline for military service, or that they had demonstrated characteristics not compatible with satisfactory continued service. The separation policy applies to soldiers who cannot meet the minimum standards prescribed for successful completion of training because of lack of aptitude, ability, motivation or self-discipline. The regulation requires uncharacterized service for separation under this chapter.

          a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.
         b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

 (1), (2), (3) and (4) The issues are rejected. The Board noted the applicant’s contentions that, in effect, he was providing his discharge papers; that he should have been provided a disability discharge; that his post service conduct warrants relief; and that his uncharacterized discharge was inequitable. However, while the available records are not complete, there is no evidence of record or independent evidence submitted by the applicant which would support his contention that he should have been discharged by reason of medical disability. The Board noted that the applicant’s record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty), authenticated by the applicant, and the Board presumed government regularity in the discharge process. The Board, being convinced that the reason for discharge and the characterization of service were proper and equitable, voted to deny relief.
