PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Note: The evidence of record shows that on 22 June 1998, Orders 173-178, DA, US Army Garrison, Aberdeen Proving Ground, MD, discharged the applicant from the Regular Army, effective date: 26 June 1998, with an uncharacterized under the provisions of Chapter 5, AR 635-200, for failure to meet procurement medical fitness standards, with an uncharacterized discharge. The applicant authenticated her DD Form 214 with her signature. That DD Form 214 indicates following facts: Character of service is an uncharacterized and she was discharge under the provisions of Chapter 5, AR 635-200, by reason of failure to meet procurement medical fitness standards.

         b. On 26 June 1998, the applicant was discharged under the provisions of Chapter 5, AR 635-200, by reason of failure to meet procurement medical fitness standards with service uncharacterized. She was credited with 9 months, and 10 days active service on the enlistment under review.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 provides the basic authority for the separation of enlisted personnel. Paragraph 5-11 specifically provides that soldiers who were not medically qualified under procurement medical fitness standards, when accepted for enlistment, or who became medically disqualified under these standards prior to entry on active duty or active duty training or initial entry training will be separated. A medical proceeding, regardless of the date completed, must establish that a medical condition was identified by appropriate medical authority within six months of the soldier’s initial entrance on active duty, that the condition would have permanently or temporarily disqualified the soldier for entry into the military service had it been detected at that time, and the medical condition does not disqualify the soldier from retention in the service under the provisions of Army Regulation 40-501, chapter 3. The characterization of service for soldiers separated under this provision of regulation will normally be honorable, but will be uncharacterized if the soldier is in an entry level status. Army regulation state that a soldier is in an entry level status if the soldier has not completed more than 180 days of creditable continuous active duty prior to the initiation of separation action.

(1) The issue is accepted. The Board carefully examined the
applicant's record of service for the period of enlistment under review.
The evidence of record indicates that the applicant was properly processed for
separation under the provisions of Chapter 5, Paragraph 5-11, AR 635-200, by
reason of failure to meet procurement medical fitness standards. However, the
Board concluded that at the time of initiation of the separation action, the
applicant was no longer in an entry-level status and her service should have been characterized. Accordingly, the Board voted to change the applicant's
uncharacterized service to fully honorable. The Board being convinced that
the reason for discharge was both proper and equitable, voted not to change
it.

         b. Equity:       The applicant has not submitted an issue of equity and the ADRB has not otherwise relied upon an issue of equity to change the discharge. The major factors upon which the discharge was based are set forth in Parts III and IV of this decisional document.
