PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 10 January 1994, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l3, AR 635 200, by reason of unsatisfactory performance, with a general, under honorable conditions discharge (GD). The applicant was advised of his rights, consulted with legal counsel, was advised of the impact of the discharge action, and submitted a statement on his behalf. The unit commander recommended separation with a GD. On 23 January 1994, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with a GD.

         b. On 4 February 1994, the applicant was discharged with a GD. At the time of discharge, the applicant had completed 3 years, 3 months, and 28 days of active military service.

         c. The applicant’s record shows that he completed over 3 years of a 4 year enlistment; that he attained the rank of private first class/E-3; and that he earned a Good Conduct Medal, the Army Commendation Medal, and the Humanitarian Service Medal. His disciplinary record includes his acceptance of an Article 15 for 2 day AWOL and several counseling statements, issued between February 1991 and November 1993, for a myriad of infractions. The unit commander processed the applicant for separation for unsatisfactory performance based on his pattern of misconduct consisting of negligent and derelict behavior.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 13 contains the policy and outlines the procedures for separating individuals for unsatisfactory performance, and provides, in pertinent part, that commanders will separate a member under this chapter when, in the commander's judgment, the member will not develop sufficiently to participate satisfactorily in further training and/or become a satisfactory soldier. Army policy states that a general discharge, under honorable conditions is normally considered appropriate, but an honorable discharge may be granted in meritorious cases.

 (1), (2), and (3) The issues are rejected. The Board noted the applicant’s contentions that his injuries impaired his ability to serve; that he had 3 years of honorable service; and that he was discharged just 6 months short of his completing his term of service. However, the Board concluded these factors, neither individually or in sum, warrant an upgrade of the applicant’s discharge. The applicant's discharge was appropriate because the quality of his service was not consistent with the Army's standards for acceptable personal conduct and performance of duty by military personnel. The applicant provided no independent corroborating evidence demonstrating that either the command's action was erroneous or that his service mitigated the misconduct or poor duty performance. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
