PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 16 November 1992, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l4, AR 635-200, by reason of misconduct—pattern of misconduct, with a general, under honorable conditions discharge (GD). The applicant was advised of his rights, consulted with legal counsel, was advised of the impact of the discharge action, and submitted a statement in his own behalf. The unit commander subsequently recommended waiver of further rehabilitative efforts. The intermediate commander reviewed the proposed discharge action and recommended approval of the separation action with a GD. On 14 December 1992, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with a GD.

         b. On 21 December 1992, the applicant was discharged with a GD. At the time of discharge, the applicant had completed 2 years, 1 months, and 22 days of active military service.

         c. The applicant’s record indicates that he had completed just over 2 years of service and attained the rank of private first class/E-3. There are no documented acts of valor, achievement, or service warranting special recognition contained in the record. However, there is a history of disciplinary infractions contained in the record. On 15 October 1991 the applicant accepted a summarized Article 15 for failing to follow an order; on 13 April 1992 he accepted an Article 15 for being derelict in the performance of his duties which included a reduction in rank to private/E-2 as part of his punishment; and on 2 July 1992 he accepted his final Article 15 for willfully and unlawfully altering a public record and the resultant punishment included a reduction in rank to private/E-1. The evidence of record shows that the unit commander processed the applicant for separation based on his establishing a pattern of misconduct.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

(1), (2), (3), and (4) The issues are rejected. The Board noted the applicant’s contentions that the copy of the sick slip in question was his own copy; that the sick slip was not an authenticated public record; that his altering his copy of the sick slip did not deprive the government the use of the document; and his question which asked if the medical aid station was a public office. However, the applicant provided no independent corroborating evidence demonstrating that either the command's action was erroneous or that his service mitigated his misconduct. The Board found no evidence of arbitrary or capricious actions by the command. Further, the Board was satisfied that all requirements of law and regulation were met, and that the rights of the applicant were fully protected throughout the separation process. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
