SUMMARY OF SERVICE : On 30 August 1995 he enlisted in the Virginia Army National Guard for a period of 8 years and training in MOS 11B (Infantryman). At the time of his enlistment he was 19 years old, had attained a General Education Diploma (GED), and achieved an Armed Forces Qualification Test score of 45 (i.e., mental category III).

He was ordered to active duty for training (ADT) with a reporting date of 12 October 1995. He reported to Fort Benning, Georgia for his ADT. On 10 November 1995 he departed Fort Benning in an AWOL status. On 10 December 1995 he was dropped from the roles as a deserter. On 22 January 1996 he was returned to military control at Fort Dix, New Jersey. On 26 January 1996 he was charged with the aforementioned AWOL. In an undated statement, the applicant, having been advised by counsel, requested discharge under the provisions of chapter 10, AR 635-200 for the good of the Service - in lieu of trial by court-martial. The applicant indicated that he understood the ramifications of his request. He submitted a handwritten statement in which he alleged that prior to having gone AWOL, he had been processed for entry level separation. On 26 January 1996 he was placed on excess leave pending adjudication of his request for a chapter 10.

On 1 February 1996 his commanding officer recommended that the applicant’s request for discharge be approved with service uncharacterized.

On 5 February 1996 the separation authority (i.e., PCF Commander) approved the applicant’s request with uncharacterized service. Accordingly, on 4 March 1996 he was discharged, in absentia, after completing 2 months and 11 days of active military service and accruing 73 days of lost time due to AWOL.

5. LEGAL/REGULATORY BASIS FOR SEPARATION : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 10 of that regulation provides, in pertinent part, that a member who has committed an offense or offenses for which the authorized punishment includes a punitive discharge may submit a request for discharge for the good of the service in lieu of trial by court-martial. The request may be submitted at any time after charges have been preferred and must include the individual's admission of guilt. Although an honorable or general discharge is authorized, a discharge under other than honorable conditions is normally considered appropriate.
