2. Finding(s), conclusion(s), and reason(s) for the Board's decision(s) on issues of propriety and/or equity:

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

         b. Equity:       The parenthetical numbers below corresponds to the issue numbers on the DD Form 293, or in Part VI, Paragraph 1, above.

(1) The issue rejected. The applicant’s unit commander notified him in writing that as initiating separation based on the applicant’s pattern of misconduct. The Board reviewed the applicant’s entire military record and noted three instances of nonjudicial punishment and numerous negative counseling statements.

         (2)(3) The issues are rejected. The Board found no evidence of arbitrary or capricious actions by the command nor did the applicant provide any to support his contentions. The Board was satisfied that all requirements of law and regulation were met and the rights of the applicant were fully protected throughout the separation process.

        (4) The issue is rejected. The record does not support the applicant's contention, and no evidence to support it has been submitted by the applicant, that three NCO’s in his company advised him that through obtaining further negative counselings, could speed up the processing of his chapter paperwork. The applicant’s issue is unclear and unspecific as to how it is a matter on which the Army Discharge Review Board grants a change in discharge. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
