THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

CONSIDERATION OF ADDITIONAL EVIDENCE:

6.  On 30 July 2015, new information was received from the Defense Finance and Accounting Service (DFAS) in regard to the decision of the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20140008134, dated 3 February 2015.

7.  The evidence submitted consists of an email, dated 30 July 2015, from DFAS.

ADDITIONAL DISCUSSION AND CONCLUSIONS:

5.  At the time of the decision of the ABCMR in Docket Number AR20140008134, dated 3 February 2015, it was the intent of the ABCMR to make the FSM’s record as administratively correct as it should properly have been at the time and to provide for payment of the SBP annuity to the surviving spouse effective 
11 March 2005, the day following the FSM's date of death.

6.  The ABCMR's decision in Docket Number AR20140008134 did not provide an effective date for payment of the RCSBP annuity to the surviving spouse.  

7.  In view of the above, the Board’s recommendation should be amended to specify that the SBP annuity for the surviving spouse should be paid effective 
11 March 2005, the day following the FSM's death.

The Board determined that the evidence presented was sufficient to warrant amendment of the decision of the Army Board for Correction of Military Records set forth in Docket Number AR20140008134, dated 3 February 2015, to show the Board also recommends paying the annuity to the FSM's surviving spouse effective 11 March 2005, the day following the FSM's death.
