IN THE CASE OF:
BOARD DATE: 16 July 2015
DOCKET NUMBER: AR20150010082
THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests a review of the military disability evaluation pertaining to a mental health (MH) condition.
2. The applicant states, in effect, the case file should be reviewed in accordance with the Secretary of Defense directive for a comprehensive review of members who were referred for a disability evaluation between 11 September 2001 and 30 April 2012, and whose MH diagnosis was changed during that process.
3. The applicant also states, that his diagnosis of Post-Traumatic Stress Disorder (PTSD) was not rated with other service connected injuries during the Medical Evaluation Board (MEB). He further states, that he was advised to accept the MEB and PTSD will be granted by the Department of Veterans Affairs (VA).
4. The applicant submitted an application through the Department of Defense (DOD) Physical Disability Board of Review (PDBR) MH Special Review Panel (SRP).
CONSIDERATION OF EVIDENCE:
1. The PDBR SRP conducted a comprehensive review of the applicant's submissions and records for evidence of inappropriate changes in the diagnosis of an MH condition during processing through the military disability system.
2. The DOD memorandum, dated 27 February 2013, directed the Service Secretaries to conduct a review of MH diagnoses for service members completing a disability evaluation process between 11 September 2001 and 30 April 2012, to determine if service members were disadvantaged by a changed diagnosis over the course of their physical disability process.
3. In the processing of this case, an advisory opinion was obtained from the PDBR SRP and the applicant was provided a copy.
4. The applicant did not respond to the advisory opinion.
DISCUSSION AND CONCLUSIONS:
1. After a comprehensive review of the applicant's case, the SRP determined by unanimous vote that there should be no change to the applicant's disability and retirement determination.
2. The SRP reviewed the records for evidence of inappropriate changes in diagnosis of the MH condition during processing through the Disability Evaluation System (DES). The evidence of the available records showed a diagnosis of anxiety/adjustment disorder was rendered during the DES process. The anxiety/adjustment diagnosis was not forwarded by the MEB or adjudicated by the Physical Evaluation Board. Therefore, the SRP determined that the applicant met the inclusion criteria in the Terms of Reference of the MH Review Project.
3. The SRP next considered whether any mental condition, regardless of diagnosis, was unfitting for continued military service. The commanders statement did not implicate a MH condition as a cause of duty impairment. At no time during the applicants military service did he require a psychiatric hospitalization or emergency care. The SRP therefore concluded that there was insufficient evidence that any MH condition rose to the level of being unfitting at the time of separation.
4. The available evidence shows the SRP's assessment should be accepted.
BOARD VOTE:

The applicant submitted an application through the DOD Physical Disability Board of Review (PDBR) MH Special Review Panel (SRP). The PDBR SRP conducted a comprehensive review of the applicant's submissions and records for evidence of inappropriate changes in the diagnosis of an MH condition during processing through the military disability system. The PDBR SRP conducted a comprehensive review of the applicants submissions and records for evidence of inappropriate changes in the diagnosis of a MH condition during processing through the military disability system. After a comprehensive review of the applicants case, the SRP determined by unanimous vote that there should be no change to the physical evaluation board (PEB)s determination that an adjustment disorder was the correct diagnosis and that it was not compensable; and...

The applicant requests a review of the military disability evaluation pertaining to a mental health (MH) condition. The SRP reviewed the records for evidence of inappropriate changes in diagnosis of the MH condition during processing through the military disability evaluation system (DES). The SRP concluded the diagnosis of adjustment disorder at the time of the MEB and PEB was correct.
ARMY | BCMR | CY2014 | 20140014269
The PDBR SRP conducted a comprehensive review of the applicants submissions and records for evidence of inappropriate changes in the diagnosis of a MH condition during processing through the military disability system. Its first assessment, under MH Review Project guidelines, was to judge whether a ratable MH diagnosis (either PTSD or anxiety disorder) was unfairly eliminated during DES proceedings. The SRP next considered whether there was preponderance of performance-based evidence...

The applicant requests a review of the military disability evaluation pertaining to a mental health (MH) condition. The SRP reviewed the records for evidence of inappropriate changes in the diagnosis of the MH condition during processing through the Disability Evaluation System (DES). The SRP noted the PTSD diagnosis was listed on the physical examination for the medical evaluation board (MEB) (DD Form 2808) without recorded PTSD symptoms.
ARMY | BCMR | CY2014 | 20140014546
The SRP reviewed the records for evidence of inappropriate changes in a diagnosis of the MH condition during processing through the military Disability Evaluation System (DES). However, the PTSD diagnosis was not considered by the physical evaluation board (PEB) and, therefore, an MH diagnosis was eliminated to the applicants possible disadvantage during that process. The SRP noted the VA examination recorded the applicants report of symptoms that were inconsistent with the treatment record.

The applicant submitted an application through the Department of Defense (DOD) Physical Disability Board of Review (PDBR) MH Special Review Panel (SRP). The PDBR SRP conducted a comprehensive review of the applicants submissions and records for evidence of inappropriate changes in the diagnosis of an MH condition during processing through the military disability system. ARMY | BCMR | CY2014 | 20140010919
The PDBR SRP conducted a comprehensive review of the applicants submissions and records for evidence of inappropriate changes in the diagnosis of a mental health condition during processing through the military disability system. The SRP also determined that no MH diagnoses were changed to the applicant's possible disadvantage in the disability evaluation process. The evidence did not support a change in the diagnosis.
