THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests the removal from her official military personnel file (OMPF) of an ARPC Form 249-E (Chronological Statement of Retirement Points).
2. The applicant states:
a. The ARPC Form (also known as AHRC Form) 249-E shouldn't have been generated. She was commissioned on 29 May 1993 at West Point and has remained on active duty without a break in service. The ARPC Form 249-E should be removed from her file. When she completed a local permanent change of station (PCS) from 1st Cavalry Division to 4th Infantry Division at Fort Hood in March of 2000, she was erroneously out-processed out of the Army instead of out of the unit. She was unaware of the issue until she completed a Pre-deployment SRP in March 2001. At that time, she no longer had a DD Form 93 (Record of Emergency Data), Servicemember's Group Life Insurance (SGLI) and her dependent child no longer showed in the Defense Enrollment Eligibility Reporting System (DEERS). She contacted the Inspector General (IG) and the local Military Personnel Division (MPD) and asked to expedite a resolution since she was deploying to Kuwait.
b. She was re-established in the system but was still showing in the Reserve database because she was notified of her selection to major (MAJ) in the Reserves the month before she was notified of her selection to MAJ in the Active Component. When this happened, she contacted the Reserve Human Resources Command (HRC) and sent them a copy of her current assignment orders. According to the J-1, the ARPC 249 Statement of Retirement Points was automatically generated and cannot be removed without going through a Board of Military Corrections. She has tried to have HRC and the MPD delete the record in the past, but it still appears. Unfortunately when it was generated, she didn't have real-time visibility of her record.

CONSIDERATION OF EVIDENCE:
1. The applicant's records show she attended the U.S. Military Academy. She was appointed as Regular Army commissioned officer and entered active duty on 29 May 1993.
2. She completed the Engineer Officer Basic Course. She served in a variety of stateside or overseas assignments and she was promoted to captain on 1 June 1997, major on 1 April 2004, and lieutenant colonel on 1 April 2010.
3. On 14 August 1997, Headquarters, Fort Leonard Wood published orders ordering her on a PCS move to Fort Hood, TX, reporting in March 1998.
4. On 25 June 1998, Headquarters, Engineer Brigade, 1st cavalry Division, Fort Hood published orders assigning her to Headquarters and Headquarters Company, 20th Engineer Brigade, effective 25 June 1998.
5. On 15 April 1998, Headquarters, III Corps published orders reassigning her to Headquarters and Headquarters Company, Division Support Command, 4th Infantry Division, effective 15 April 2000.
6. It appears she deployed to Kuwait on or about 3 April 2001 and returned to Fort Hood on or about 13 August 2001 and again from 14 November 2001 to 4 April 2002. She returned to Fort Hood.
7. On 3 May 2002, Headquarters, III Corps, Fort Hood published orders reassigning her from Fort Hood to the Student Detachment, Fort Jackson, SC with duty at the University of Kansas, on or around 15 August 2002.
8. On 16 March 2005, Headquarters, Fort Leavenworth published orders reassigning her to the 25th Infantry Division in Hawaii, on or about 26 July 2005.
9. She is currently assigned to the Joint Staff at the Pentagon.
10. Her OMPF contains an ARPC Form 249-E, dated 4 March 2013. This form shows her as a Regular Army commissioned officer from 29 May 1993 through 13 November 2000. It also shows her as a U.S. Army Reserve commissioned officer from 14 November 2000 to 28 May 2003. No other entries are made beyond that date. This form was added to her OMPF on 28 March 2003.
11. The Retirement Points Accounting System (RPAS) is a system used by the Selected Reserve of the Army. It provides an annual listing of creditable military service through the previous retirement year. The AHRC Form 249-2-E (Chronological Statement of Retirement Points) and (Detail Point Listing for Previous Retirement Year) are computed within 30 days after the retirement year end (RYE) date and necessitates prompt submission of points as they are earned throughout the retirement year to facilitate accuracy. This form establishes qualifying years of service for Reserve personnel.
DISCUSSION AND CONCLUSIONS:
1. The applicant was appointed as a Regular Army commissioned officer on 29 May 1993. She served her entire military service as a Regular Army commissioned officer. She was never in the USAR and there was never a need to track her retirement points via the ARPC Form 249-E or a need to create one for her.
2. The OMPF is an unbroken record of a Soldier's service, conduct, duty performance, and evaluation periods. Unless directed by certain agencies, once a document is placed in the OMPF, it becomes a permanent part of that file.
3. Here, it is clear that this form was erroneously added to her OMPF. It serves no purpose and sticks out when her records are reviewed for promotion, assignments, or schooling. The applicant's desire to present an accurate OMPF for future personnel decision is a respectable motive. The erroneous ARPC Form 249-E should be removed from her OMPF.
