BOARD DATE: 15 September 2015
DOCKET NUMBER: AR20150002071
THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his social security number (SSN) as "xxx-xx-xxx2" vice "xxx-xx-xxx4."
2. The applicant states his DD Form 214 listed the wrong SSN.
3. The applicant provides his DD Form 214 and his Honorable Discharge Certificate.
CONSIDERATION OF EVIDENCE:
1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.
2. In connection with his enlistment in the Regular Army (RA), the applicant completed a DD Form 398 (Statement of Personal History) wherein he disclosed his SSN as "xxx-xx-xxx2." He authenticated this form with his signature.
3. He enlisted in the RA on 14 June 1965. His DD Form 4 (Enlistment Record) listed his Service Number; it did not list his SSN. His DA Form 20 (Enlisted Qualification Record), which was created upon his entry on active duty listed his SSN as "xxx-xx-xxx4."
4. His records contain multiple documents that reflect his SSN "xxx-xx-xxx2." He authenticated some of these documents, as required, with his signature. These documents include a DA Form 41 (Record of Emergency Data).
5. He was honorably released from active duty on 6 June 1968. He was transferred to the U.S. Army Reserve Control Group to complete his remaining service obligations. Item 3 (SSN) of his DD Form 214 shows his SSN as "xxx-xx-xxx4."
6. He was ultimately discharged from the U.S. Army Reserve on 13 June 1971. He was issued an Honorable Discharge Certificate that listed his SSN as "xxx-xx-xxx2."
7. Army Regulation 635-5 (Separation Documents) at the time established the standardized policy for preparing and distributing the DD Form 214. The regulation directs, in pertinent part, that the purpose of the separation document is to provide the individual with documentary evidence of his or her military service. It is important that information entered on the form should be complete and accurate.
DISCUSSION AND CONCLUSIONS:
The evidence of record shows upon his enlistment in the RA the applicant disclosed his SSN as "xxx-xx-xxx2." This SSN is consistent with the SSN shown on some documents in his service record. It appears an administrative error occurred when his DD Form 214 was processed. In view of the foregoing, his DD Form 214 should be corrected as recommended below.
BOARD VOTE:
___X_____ __X_____ __X_ GRANT FULL RELIEF
________ ________ ________ GRANT PARTIAL RELIEF

BOARD DETERMINATION/RECOMMENDATION:
The Board determined that the evidence presented was sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by deleting from item 3 of his DD Form 214 the current entry and replacing it with the SSN shown on his Honorable Discharge Certificate.

The applicant requests correction of the social security number (SSN) shown on his DD Form 214 (Certificate of Release of Discharge from Active Duty). His record contains a DD Form 215 (Correction to DD Form 214), dated 10 June 1992, which also list his SSN in item 3 as xxx-xx-xxx4. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by deleting from his DD Form 214 the current SSN entry and replacing it with the SSN as listed...

The evidence of record shows the applicant enlisted in the RA on 8 July 1968. However, throughout the applicant's active duty service no evidence was present listing the applicant's SSN as anything other than "xxx-xx-xxx4." ___________X____________ CHAIRPERSON I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case.

The applicant requests correction of his DD Form 214 (Report of Separation from Active Duty) for the period ending 22 March 1977 to show his social security number (SSN) as "xxx-xx-xxx9" instead of "xxx-xx-xxx4." Therefore, lacking convincing independent and verifiable evidence to the contrary, it is presumed that the applicant's military service records, including the DD Form 214, was correct at the time, and there is insufficient evidence to grant him relief in this case. ABCMR Record of...

His record contains some personnel, medical, and other documents that mostly listed his service number; however, when his SSN is listed it is shown as "xxx-xx-xxx9." It appears an administrative error occurred when his DD Form 214 was prepared that lists his SSN as "xxx-xx-xxx4," which is the only document in his available record with such an SSN. Therefore, it would be appropriate at this time to correct his DD Form 214 to show his correct SSN.

Some of the documents filed in his record list his SSN as "xxx-xx-xxx4" while others list his SSN as "xxx-xx-xxx5." Therefore, the applicant is entitled to correction of his DD Form 214 to show his correct SSN of "xxx-xx-xxx4." In the absence of official orders or other documentary evidence, such as operation reports, after action reports, valor awards, witness statements, or any other evidence that conclusively shows he participated in active ground combat while assigned to an infantry...

The applicant states the SSN recorded on his DD Form 214 should be "xxx-xx-xxx4" instead of "xxx-xx-xxx0." The evidence of record shows that the U.S. Army was not using the SSN at the time the applicant initially entered active duty. Therefore, it would be appropriate to correct the applicant's 4 April 1969 DD Form 214 to show his SSN as "xxx-xx-xxx4."
