THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests correction of item 25 (Education and Training Completed) of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show he completed the Armor Reconnaissance Training Course and the M551 Sheridan Tank Driver's Course instead of the Truck Driver's Course.
2. He states he did not take a truck driver training course; however, he completed an armor reconnaissance training course. He adds that he also completed a 4-week course on the M551 Sheridan Tank.
3. He provides his DD form 214 and DA Form 20 (Enlisted Qualification Record).
CONSIDERATION OF EVIDENCE:
1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.
2. The applicant enlisted in the Regular Army on 17 June 1970. He was trained in and awarded military occupational specialty (MOS) 11D (Armor Reconnaissance Specialists) effective 30 October. He served in Korea from
8 January 1971 to 14 August 1972.
3. His DA Form 20 shows in:
a. Item 22 (MOSs) Secondary MOS (SMOS) 11D, 30 October 1970. A Primary MOS (PMOS) 11B (Light Weapons Infantryman) effective 16 February 1971.
b. Item 27 (Military Education) M551 Sheridan Tank Driver's Course, 11D, U.S. Army Training Center, Armor (USATCA), 4 weeks, 1970.
c. Item 38 (Record of Assignments) the effective date, duty MOS, and principal duty as follows:
* 29 June 1970, 09B (Trainee), Basic Combat Training
* 8 September 1970, 11D, Advanced Individual Training, USATCA
* 12 December 1970, Casual, en route to U.S. Army Pacific (USARPAC) (Korea)
* 15 January 1971, 11B, Rifleman, Company C, 2nd Battalion, 2nd Infantry Division
* 16 June 1971, 11B, Light Weapons Infantryman, Company C,
1st Battalion, 17th Infantry
* 31 May 1972, 11B, Personnel Carrier Driver, Company C, 1st Battalion, 17th Infantry

4. The applicant was honorably released from active duty on 22 June 1973 and he was credited with completing 3 years of active service. His DD Form 214 shows in item 25 "USATLA 4 weeks 1970 Truck Driver's Course."
5. The applicant's record is void of any evidence that shows he attended the Truck Driver's Course.
6. Army Regulation 635-5 (Separation Documents) at the time established standardized policy for preparing and distributing the DD Form 214. Paragraph 2-4, in pertinent part, requires the preparer to enter in item 25 the service schools, including major courses which were successfully completed, and military sponsored courses completed in civilian schools and colleges during the period covered by the DD Form 214 being prepared.
DISCUSSION AND CONCLUSIONS:
1. There is no evidence that shows the applicant attended a truck driver's course for 4 weeks in 1970. Therefore, it appears this entry on his DD Form 214 is incorrect.
2. His DA Form 20 confirms he completed the M551 Sheridan Tank Driver's Course at USATCA for 4 weeks in 1970 and this course should be annotated on his DD Form 214.
3. The evidence of record shows he completed the Armor Reconnaissance Training Course at USATCA effective 30 October 1970 and this course should be annotated on his DD Form 214.

BOARD DETERMINATION/RECOMMENDATION:
The Board determined that the evidence presented was sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:
a. removing "USATLA 4 weeks 1970 Truck Driver's Course" from item 25 of his DD Form 214; and
b. adding to item 25 of his DD Form 214 "M551 Sheridan Tank Driver's Course, USATCA, 4 weeks, 1970" and "Armor Reconnaissance Training Course, USATCA,1970."
