THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests reconsideration of his earlier request for award of the Humanitarian Service Medal for work done on Enewetak.
2. The applicant states his DD Form 214 does not reflect this award and he is now providing the necessary documents as proof he was there and involved in the clean-up efforts on Enewetak Atoll, Marshall Islands.
3. The applicant provides:
* DA Form 4036-R (Medical and Dental Preparation for Overseas Movement)
* DA Form 137 (Installation Clearance Record)
* DA Form 613 (Checklist for Preparation of Replacement for Overseas Movement)
* DD Form 1610 (Request and Authorization for Temporary Duty (TDY) Travel of DOD Personnel)
* Enewetak Clean-Up Detail
CONSIDERATION OF EVIDENCE:
1. Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20130006340 on 26 November 2013.
2. The applicant provides the documents listed in paragraph 3 above. These documents were not previously submitted or considered. This warrants consideration of his case by the Board.
3. The applicant's records show he enlisted in the Regular Army on 18 June 1976. He completed basic combat and advanced individual training and he was awarded military occupational specialty 62B (Engineer Equipment Mechanic).
4. He was assigned to Company C, 39th Engineer Battalion, Fort Devens, MA, from 1 October 1976 to 30 January 1979. He provides the following documents:
a. DD Form 1610, dated 13 June 1978, ordering him to go TDY from Fort Devens, MA to Hawaii and Enewetak Atoll on or about 26 June 1978 for 120 to 179 days to support clean-up of the Atoll in the Marshall Islands.
b. A memorandum, dated 26 May 1978, issued by Headquarters, Fort Devens, listing the documents that individuals must carry and arrive with in Hawaii in their possession.
c. DA Form 137, dated 15 June 1978, that shows the applicant outprocessed the 39th Engineer Battalion en route to the Enewetak Atoll.
d. DA Form 4036-R and DA Form 613 completed in connection with his travel to Enewetak Atoll.
5. He was honorably released from active duty on 9 June 1980 and he was transferred to the U.S. Army Reserve. He completed 3 years, 11 months, and 22 days of net active service this period. His DD Form 214 (Certificate of Release or Discharge from Active Duty) show she was awarded or authorized the:
* Army Good Conduct Medal
* Marksman Marksmanship Qualification Badge with Rifle Bar (M-16)
6. Army Regulation 600-8-22 (Military Awards) states:
a. The Humanitarian Service Medal is awarded to members who distinguished themselves by meritorious direct participation in a Department of Defense approved significant military act or operation of a humanitarian nature. A service member must be on active duty at the time of direct participation, must have directly participated in the humanitarian act or operation within the designated geographical area of operation and within specified time limits, and must provide evidence that substantiates direct participation.
b. Table C-1 of Army Regulation 600-8-22 shows the Enewetak Radiological Cleanup (24 January 1977 to 15 April 1980) in Enewetak Atoll, Marshall Islands was approved by the Department of Defense as qualifying for award of the Humanitarian Service Medal.
DISCUSSION AND CONCLUSIONS:
1. Award of the Humanitarian Service Medal requires evidence that the Soldier directly participated in the humanitarian operation within the designated geographical area of operation and within specified time limits for which this award was authorized.
2. The evidence provided by the applicant clearly established he was ordered to travel in a TDY status from Fort Devens, MA to Enewetak Atoll, Marshall Islands to help with the clean-up detail. Despite the absence of evidence of direct participation, given the applicant's MOS as an Engineer Equipment Mechanic, it is reasonable to presume he directly participated in the clean-up detail.
3. It appears he meets the criteria for this award and it should be added to his DD Form 214.

DD Form 214 the Humanitarian Service Medal.
