THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show he completed the Military Assistance Command Vietnam (MACV) Recondo School.
2. The applicant states:
* he graduated from the MACV Recondo School in January 1968, but it is not reflected on his DD Form 214
* this was an elite prestigious school
* he is most proud of this accomplishment
* omission from his records excludes an important part of his service
3. The applicant provides:
* MACV Recondo School Certificate
* photographs of himself wearing the Recondo patch
* photographs of Soldiers
* newspaper article about Recondo training
CONSIDERATION OF EVIDENCE:
1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.
2. The applicant enlisted in the Regular Army on 15 June 1965 for a period of 3 years. He completed his training and was awarded military occupational specialty 11B (light weapons infantryman).
3. He provided:
a. a certificate, dated 28 January 1967, which shows he completed the MACV Recondo School; and
b. an article from the Stars and Stripes pertaining to the 3-week training course/Recondo School.
4. On 14 June 1968, he was honorably released from active duty.
5. Item 25 (Education and Training Completed) of his DD Form 214 shows he completed:
* 2 years of high school
* 6-week Basic Noncommissioned Officer Course
* 3-week Basic Airborne Course
REFERENCES:
Army Regulation 635-5 (Separation Documents), in effect at the time, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It established standardized policy for preparation of the DD Form 214. The instructions stated to enter service schools, including major courses which were successfully completed, and military sponsored courses completed in civilian schools and colleges during the period covered by the DD Form 214 in item 25. For enlisted personnel, enter installation training courses (qualification courses), military correspondence courses, and off-duty courses completed during the period covered by the DD Form 214.
DISCUSSION:
The evidence shows the applicant completed the 3-week MACV Recondo School in January 1967. Item 25 of his DD Form 214 does not show this training.
