THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to reflect his date of birth (DOB) as 3 April 1942 instead of 4 March 1942.
2. The applicant states he discovered the error when applying for benefits with the Department of Veterans Affairs.
3. The applicant provides his DD Form 214.
CONSIDERATION OF EVIDENCE:
1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.
2. The applicant enlisted in the Regular Army on 10 July 1959. His DD Form 4 (Enlistment Record Armed Forces of the United States) lists his DOB as 4 March 1942.
3. His records contain the following documents which list his DOB as 3 April 1942:
* DA Form 873 (Certificate of Clearance and/or Security Determination Under Executive Order 10450)
* DD Form 398 (Statement of Personal History)
4. On 23 May 1962, he was honorably released from active duty and transferred to the U.S. Army Reserve Control Group (Annual Training). Item 6 (DOB) of his DD Form 214 shows his DOB as 4 March 1942.
5. Army Regulation 635-5 (Separation Documents), in effect at the time, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It established standardized policy for preparation of the DD Form 214. It stated the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge.
DISCUSSION AND CONCLUSIONS:
1. The applicant's contention that his DD Form 214 should be corrected to show his DOB as 3 April 1942 was carefully considered.
2. His records contain several documents reflecting his DOB as 3 April 1942. Therefore, his DD Form 214 should be corrected to show his DOB as it is listed on his DA Form 873.

As a result, the Board recommends denial of so much of the application that pertains to correcting the FSM's DD Form 214 to show his DOB as 17 January 1942.

The DA Form 20 (Enlisted Qualification Record) that was created at the time he entered the Army shows his DOB as "2 Jun 42." Item 6 (DOB) of the DD Form 214 for this period of service shows the entry "2 Jun 43." Although the applicant's DD Form 47 listed his DOB as 2 June 1943 upon his induction, other than his DD Form 214 for the period ending 27 November 1963 all other documents contained in his official military records show his DOB as 2 June 1942.
