THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests reconsideration of his request for correction of his          DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show award of the Bronze Star Medal (BSM). 

2.  The applicant states a typist made an error by not listing the BSM on his       DD Form 214.  

3.  The applicant provides his DD Form 214 and an excerpt from the Army Times. 

CONSIDERATION OF EVIDENCE:

1.  Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant’s case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20080009724, on 19 August 2008.  

2.  The applicant provides new evidence that warrants reconsideration by the Board.

3.  He was appointed as a Reserve commissioned officer on 6 June 1965.  He was ordered to active duty on 8 July 1965.      

4.  His DA Form 66 (Officer Qualification Record) shows in item 21 (Awards and Decorations) the following awards:
* National Defense Service Medal (NDSM)
* Vietnam Service Medal (VSM)
* Republic of Vietnam (RVN) Campaign Medal with Device (1960)

5.  On 30 October 1968, he was honorably released from active duty and transferred to the U. S Army Reserve.  His DD Form 214 shows he was awarded or authorized the following awards:

* NDSM
* VSM
* RVN Campaign Medal with Device 91960)

6.  His record is void of documentation showing he was awarded or recommended for award of the BSM.

7.  Review of the Awards and Decorations Computer Assisted Retrieval System (ADCARS), an index of general orders issued during the Vietnam era between 1965 and 1973 maintained by the Awards and Decorations Branch of the U.S. Army Human Resources Command, failed to reveal any orders for the BSM pertaining to the applicant.

8.  He provides an excerpt from the Army Times, dated 2 October 1968, which reported he received the BSM.

9.  Army Regulation 600-8-22 (Military Awards) states the BSM is awarded in time of war for heroism and for meritorious achievement or service, not involving participation in aerial flight, in connection with military operations against an armed enemy, or while engaged n military operations involving conflict with an opposing armed force in which the United States is not a belligerent party.  As with all personal decorations, formal recommendations, approval through the chain of command, and announcement in orders are required.  

DISCUSSION AND CONCLUSIONS:

1.  The applicant contends that a clerical error was made and his BSM was not included on his DD Form 214.

2.  His record is void of documentation showing he was awarded or recommended for award of the BSM.  He provides an excerpt from the Army Times showing he was awarded the BSM; however, absent orders which officially awarded him this medal or official documentation confirming that such orders were published, there is an insufficient basis upon which to correct his DD Form 214 to show the BSM.
