THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in effect, correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show he was awarded the Combat Infantryman Badge.

2.  The applicant states he received this award at an award ceremony in Afghanistan, and he witnessed events that led to him receiving this award.

3.  The applicant provides no additional evidence in support of his request.

CONSIDERATION OF EVIDENCE:

1.  The applicant enlisted in the Regular Army on 26 January 2010.  He completed his initial entry training and was awarded military occupational specialty 11B (Infantryman).  The highest rank/grade he attained during his period of military service was private first class/E-3.

2.  He served in Afghanistan in support of Operation Enduring Freedom during the period 23 August 2010 through 6 August 2011.  During this period, he was assigned to the 1st Battalion, 506th Infantry Regiment, 101st Airborne Division.

3.  He was discharged from the Army on 10 April 2012.  His DD Form 214 shows he was awarded or authorized the:

* Army Commendation Medal
* National Defense Service Medal
* Afghanistan Campaign Medal with 2 bronze service stars
* Global War on Terrorism Service Medal
* Army Service Ribbon
* Overseas Service Ribbon
* North Atlantic Treaty Organization (NATO) Medal

4.  His record is void of any documentation that shows he was awarded the Combat Infantryman Badge.  Additionally, his record is void of any documentation that shows he was personally present and engaged the enemy in active ground combat.  

5.  Army Regulation 600-8-22 (Military Awards) states the Combat Infantryman Badge may be awarded to an infantryman satisfactorily performing infantry duties, while assigned to an infantry unit during such time as the unit is engaged in active ground combat, and actively participating in such ground combat.  A Soldier must be personally present and under hostile fire while serving in an assigned infantry or special forces primary duty, in a unit actively engaged in ground combat with the enemy.  

DISCUSSION AND CONCLUSIONS:

1.  There are basically three requirements for award of the Combat Infantryman Badge.  The Soldier must be an infantryman satisfactorily performing infantry duties, he must be assigned to an infantry unit during such time as the unit is engaged in active ground combat, and he must actively participate in such ground combat.

2.  The applicant's infantry MOS and assignment to an infantry unit during his service in Afghanistan are not in question.  However, there is no evidence and he did not submit any evidence that shows he was personally present and under hostile fire while his unit was actively engaged in ground combat with the enemy. 

3.  Absent further corroborating evidence such as official orders, witness statements, or letters of support from members of his chain of command that attest to his involvement in active ground combat, there is, at this time, insufficient evidence to show he was either previously awarded the Combat Infantryman Badge or eligible for award of the Combat Infantryman.
