THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of the dates of his deployment for Operation Enduring Freedom (OEF) on his DD Form 214 (Certificate of Release or Discharge from Active Duty).

2.  The applicant states the dates listed on his DD Form 214 are incorrect.  He was deployed twice from 5 May 2002 to 15 October 2002 and from 20 June 2003 to 1 October 2003.

3.  The applicant provides a copy of his DD Form 214 and DA Forms 638 (Recommendation for Award).

CONSIDERATION OF EVIDENCE:

1.  On 16 April 1997, the applicant enlisted in the Regular Army.  

2.  On 7 September 2002, the applicant was submitted and approved for an Army Commendation Medal while attached to the Combined Joint Special Operations Task Force - Afghanistan (CJSOTF-AFG), with operational detachment Bravo 340 during the conduct of unconventional warfare combat operations in support of OEF from 5 May 2002 to 15 October 2002.

3.  On 10 August 2003, the applicant was submitted and approved for an ARCOM (2nd Award) while detached to the CJSOTF-AFG in support of OEF from 20 June 2003 to 1 October 2003.  

3.  On 5 December 2004, the applicant was honorably released from active duty service and transferred the U.S. Army Reserve.  

4.  His DD Form 214 shows:

* Item 12f (Record of Service - Foreign Service):  2 years, 3 months, and 8 days
* item 18 (Remarks) contains the following entry: "SERVICE IN OPERATION ENDURING FREEDOM (AFGHANISTAN) FROM 20040610 TO 20040915"

5.  An email from the Defense Finance and Accounting Service (DFAS), dated 
24 October 2014, shows the applicant received hostile fire/imminent danger pay (HF/IDP) and combat zone tax exclusion (CZTE) from 17 June 2003 through 
26 September 2003, for Afghanistan.

6.  Army Regulation 635-5 (Separation Documents), in effect at the time, established the standardized policy for preparing the DD Form 214.  It directed that when an active duty Soldier was deployed with his unit during the period covered by the DD Form 214, the entry "SERVICE IN (name of country) FROM (inclusive dates in YYYY/MM/DD format) was to be made in item 18.

DISCUSSION AND CONCLUSIONS:

1.  The deployment entry on his DD Form 214 is clearly in error.  Using the DFAS dates showing he received HF/IDP and CZTE, it can be determined his dates in Afghanistan were from 17 June 2003 through 26 September 2003.  

2.  Although there are no orders in his official military personnel file (OMPF) to show he was deployed to Afghanistan in 2002, the approval of his ARCOM shows he was in Afghanistan in support of OEF.  Therefore, his DD Form 214 should be corrected to show "SERVICE IN AFGHANISTAN:  20020505 through 20021015 and 20030617 through 20030926."

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by 
amending item 18 of his DD Form 214 as follows:

* deleting "SERVICE IN OPERATION ENDURING FREEDOM AFGHANISTAN FROM 20040610 to 20040915"
* adding "SERVICE IN OPERATION ENDURING FREEDOM AFGHANISTAN FROM 20020505 through 20021015 and 20030617 through 20030926"
