THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests that his DD Form 214 (Certificate of Release or Discharge from Active Duty) be corrected to reflect his completion of the Signal Intelligence/Electronic Warfare Course of 4 weeks in 1993 and the Cryptologic Skills for Junior Officers Course of 16 weeks in 1993.
2. The applicant states he completed the two courses and they were not included on his DD Form 214.
3. The applicant provides copies of his DD Form 214 and course completion certificates.
CONSIDERATION OF EVIDENCE:
1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.
2. The applicant was commissioned as a U.S. Army Reserve second lieutenant on 28 July 1987 and was ordered to active duty on 3 February 1988. He completed his training as an air defense artillery officer and served in a variety of assignments. He was assigned to Fort Meade, Maryland on 12 August 1993.
3. He completed the Signal Intelligence/Electronic Warfare Course of 4 weeks in 1993 and the Cryptologic Skills for Junior Officers Course of 16 weeks in 1993.
4. On 1 April 2000, while assigned to Fort Riley, Kansas, he was honorably released from active duty (REFRAD) due to completion of required service. His DD Form 214 issued at the time of his REFRAD shows he completed the military education courses of CAS3 1994, Military Intelligence (MI) Officer Tactical Intelligence Course 1992, MI Officer Advanced Course 1992, Chaparral/Vulcan Officer Qualification Course 1988 and the Air Defense Officer Basic Course 1988.
DISCUSSION AND CONCLUSIONS:
1. The applicant completed the Signal Intelligence/Electronic Warfare Course in 1993 and the Cryptologic Skills for Junior Officers Course in 1993 and is entitled to have those courses added to his DD Form 214.
2. Accordingly, it would appropriate to add those courses to his DD Form 214 at this time.
