THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of her DD Form 214 (Certificate of Release or Discharge from Active Duty) to show she was awarded the Global War on Terrorism Service Medal.  She also requests issuance of the medal.

2.  The applicant states she is authorized award of the Global War on Terrorism Service Medal according to Army Regulation (AR) 600-8-22 (Military Awards).

3.  The applicant provides a copy of her DD Form 214, a page from AR 600-8-22 governing the Global War on Terrorism Service Medal, and a four-page extract from the U.S. Army Human Resources web site describing the Global War on Terrorism Service Medal.

CONSIDERATION OF EVIDENCE:

1.  Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice.  This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so.  While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file.  In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.
2.  The applicant served in the Indiana Army National Guard and the Wyoming Army National Guard (WYARNG).

3.  She last entered active duty on 14 May 1991 as a member of the WYARNG.

4.  She was placed on the Temporary Disability Retired List on 16 December 2002 as a sergeant first class/E-7.  She had completed 11 years, 7 months, and 
3 days of active duty service during the period covered by this DD Form 214 and a total of 14 years 1 month and 16 Days of total active duty service.  Her 
DD Form 214 shows her awards as the Meritorious Service Medal (2 Awards), Army Commendation Medal (2 Awards), Army Achievement Medal, Army Good Conduct Medal (4 Awards), Army Reserve Components Achievement Medal, National Defense Service Medal (2 Awards), Armed Forces Reserve Medal 
(2 Awards), Noncommissioned Officer Professional Development Ribbon with Numeral 3, Army Service Ribbon, and the Army Aviator Badge. 

5.  Army Regulation 600-8-22 (Military Awards) states the Global War on Terrorism Service Medal is authorized for award to all Soldiers on active duty on or after 11 September 2001 to a date to be determined. 

DISCUSSION AND CONCLUSIONS:

1.  The available evidence shows she served a qualifying period of service for entitlement to the Global War on Terrorism Service Medal.

2. Therefore, her DD Form 214 should be corrected to show this award and the award should be issued to her.

Department of the Army records of the individual concerned be corrected by adding to her DD Form 214 the Global War on Terrorism Service Medal and issuing the award to her.
