THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests payment of his Nurse Corps Incentive Special Pay (ISP) for 2013.

2.  The applicant states his paper work was submitted along with that of his classmates.  About 50 percent of them received their ISP.  

3.  The applicant provides copies of his request for ISP, his Virginia state registered nurse license, and his American Association of Critical Care Nurses certification.

CONSIDERATION OF EVIDENCE:

1.  The applicant was appointed a Regular Army first lieutenant in the Nurse Corps on 28 February 2013.

2.  On 13 July 2014, he completed the 12-month long Phase I of the Army's doctoral program for nurse anesthetists.  His DA Form 1059 (Service School Academic Report) indicated he was well-prepared for residency.  

3.  During the processing of this case, a staff advisory opinion was obtained from the Special Pay Branch of the Office of the Surgeon General (OTSG).  The Chief, Army Medical Department Special Pay Branch noted that sufficient performance of duty to maintain proficiency in the specific specialty, as well as qualifying credentials, were required for the payment of ISP.  He concluded that the applicant was not eligible to execute the contract for the ISP as a critical care nurse because he was not practicing in that field.  

4.  The advisory opinion was forwarded to the applicant for rebuttal or response.  No reply was received within the allotted time.

DISCUSSION AND CONCLUSIONS:

1.  The applicant was not eligible for ISP because he was engaged in training for another specialty rather that practicing as a critical care nurse.  

2.  The applicant has submitted neither probative evidence nor a convincing argument.  There is no basis for granting the applicant's request.
