THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show his combat service in Afghanistan from 28 September 2002 to 30 March 2003. 

2.  The applicant states when he signed his DD Form 214 he didn't notice this period of his foreign service was not listed on the DD Form 214.

3.  The applicant provides his DD Form 214, DA Form 638 (Recommendation for Award), and an award certificate.

CONSIDERATION OF EVIDENCE:

1.  The applicant enlisted in the Regular Army on 8 November 1988.  He served continuously through several reenlistments and/or extensions and was promoted to the rank/grade of sergeant first class (SFC)/E-7 on 1 June 2001.

2.  The applicant provides:

	a.  A DA Form 638, dated 8 January 2003, wherein the Commander, Combined Joint Task Force (CJTF) 180, Afghanistan, recommended the applicant be awarded the Bronze Star Medal for the period 28 September 2002 to 30 March 2003.

   b.  A certificate, dated 16 March 2003, wherein it shows he was awarded the Bronze Star Medal for exceptionally meritorious service while deployed to Afghanistan from 28 September 2002 to 30 March 2003.

3.  He was retired from active duty on 31 March 2014 in the rank of SFC and he was placed on the Retired List on 1 April 2014.

4.  Item 18 (Remarks) of the DD Form 214 he was issued shows he served in hostile fire/imminent danger pay areas as follows:

* Iraq - 7 August 2010 to 26 February 2011
* Afghanistan - 1 February to 1 November 2007
* Afghanistan - 11 January to 27 August 2006
* Kuwait - 17 January to 1 April 1991
* Saudi Arabia - 12 October 1990 to 16 January 1991

5.  His record contains his Enlisted Record Brief (ERB), dated 1 April 2014, wherein it shows, in part, he served in Afghanistan from 28 September 2002 to 20 March 2003.

6.  Section IX (Assignment Information) of this ERB shows effective 21 March 2003 he was assigned as the Communications Sergeant, Company C, 2nd Battalion, 7th Special Forces Group (SFG), Fort Bragg, NC.

DISCUSSION AND CONCLUSIONS:

1.  The evidence of record shows the applicant served in Afghanistan from 28 September 2002 to 20 March 2003 which is not shown on his DD Form 214.  Therefore, his DD Form 214 should be corrected to show this foreign service in Afghanistan.

2.  With respect to showing he served in Afghanistan from 28 September 2002 to 30 March 2003, he has not provided any evidence that conclusively shows he served in Afghanistan after 20 March 2003.  Although he was recommended for award of the Bronze Star Medal for the period 28 September 2002 to 30 March 2003, the recommendation was dated 8 January 2003 and the certificate for this award was dated 16 March 2003.  However, his ERB shows he was deployed to Afghanistan from 28 September 2002 to 20 March 2003 and he was assigned to a position at Fort Bragg on 21 March 2003.  Therefore, he is not entitled to full relief.

BOARD DETERMINATION/RECOMMENDATION:

1.  The Board determined that the evidence presented was sufficient to warrant a recommendation for partial relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending his DD Form 214 by adding to item 18 the entry "SERVICE IN AFGHANISTAN 20020928-20030320." 

2.  The Board further determined that the evidence presented was insufficient to warrant a portion of the requested relief.  As a result, the Board recommends denial of so much of the application that pertains to showing he served in Afghanistan from 28 September 2002 to 30 March 2003.
