THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his DD Form 214 (Report of Separation from Active Duty) to show his social security number (SSN) as XXX-XX-89XX instead of XXX-XX-78XX.

2.  The applicant states:

* his SSN is listed incorrectly on his DD Form 214
* he is trying to obtain veterans' health benefits and he needs to have his DD Form 214 corrected to properly submit all of the required documentation and forms

3.  The applicant provides:

* DD Form 214
* letter from the National Personnel Records Center (NPRC), dated 11 June 2014
* social security card
* driver's license
* affidavit, license, and certificate of marriage
* utility bill

CONSIDERATION OF EVIDENCE:

1.  Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice.  This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so.  While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file.  In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.

2.  On 26 December 1973, the applicant underwent a physical examination prior to enlistment.  His Standard Form 93 (Report of Medical History) shows his SSN as XXX-XX-89XX.

3.  He enlisted in the U.S. Army Reserve on 9 January 1974 for a period of 6 years.

4.  His DD Form 4 (Enlistment Contract – Armed Forces of the United States) shows his SSN as XXX-XX-87XX.

5.  On 8 February 1974, he was ordered to active duty for training.

6.  On 18 March 1974, he was honorably discharged.  He completed 1 month and 11 days of total active service.  His DD Form 214 shows his SSN as 
XXX-XX-78XX.

7.  He provided a copy of his social security card that shows his SSN as 
XXX-XX-89XX.

8.  Army Regulation 635-5 (Separation Documents), in effect at the time, established standardized policy for preparing and distributing the DD Form 214.  The purpose of the separation document is to provide an individual with documentary evidence of his or her military service.  It is important that information entered on the form is complete and accurate.

DISCUSSION AND CONCLUSIONS:

The evidence of record shows the applicant provided the requested SSN during his enlistment processing.  It appears his SSN was transcribed incorrectly at the time of his entry on active duty.  Therefore, he is entitled to correction of his DD Form 214 to show his SSN as it appears on his social security card.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined the evidence presented is sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by deleting the current SSN entry shown on his DD Form 214 and replacing it with the SSN shown on his social security card.
