		IN THE CASE OF:

		BOARD DATE: 4 December 2014

		DOCKET NUMBER: AR20140007502

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1. Application for correction of military records (with supporting documents provided, if any).

2. Military Personnel Records and advisory opinions (if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests correction of his middle name on his DD Form 214 (Report of Transfer or Discharge) and DD Form 215 (Correction to DD Form 214).

2. The applicant states his middle name is spelled Fredrick, not Frederick.

3. The applicant provides a copy of his birth certificate.

CONSIDERATION OF EVIDENCE:

1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.

2. The applicant spelled his middle name Fredrick on the DD Form 398 (Statement of Personal History) that he submitted for his 11 January 1968 induction. The only places in his record where his middle name appears as Frederick is on his 16 August 1969 DD Form 214 and 28 July 2011 DD Form 215.

DISCUSSION AND CONCLUSIONS:

The applicant's middle name was misspelled on his DD Forms 214 and 215. It should be corrected as recommended below.

BOARD VOTE:

____x___ ____x___ ___x____ GRANT FULL RELIEF

________ ________ ________ GRANT PARTIAL RELIEF

________ ________ ________ GRANT FORMAL HEARING

________ ________ ________ DENY APPLICATION

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by correcting the spelling of his middle name on his DD Forms 214 and 215 to
"Fredrick."

The applicant provides his DD Form 214. The DA Form 20 (Enlisted Qualification Record) that was created at the time he entered the Army shows his middle initial as F. He authenticated this form by placing his signature in the appropriate block on 16 August 1965 and reviewing the form at a later date. Item 1 of the DD Form 214 he was issued shows the initial "A" between his first and middle name and shows his middle name as "Fredrick."

The applicant states, in effect, that the middle name and year of his birth that are recorded in his military service records are incorrect. The evidence of record shows that the applicant's place of birth is recorded in his military service records as "St. Mary's, Pennsylvania." However, the applicant's Notification of Birth Registration that is presented as evidence in this case shows that the applicant's place of birth was "Benzinger Township, Pennsylvania."

All other documents in the applicant's Army Military Human Resource Record (AMHRR), formerly known as the Official Military Personnel File (OMPF), bearing his middle name shows the middle name as "Fredric." Therefore, it would be appropriate at this time to correct his DD Form 214 accordingly. _______ _ __x_____ ___ CHAIRPERSON I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case.

The evidence of record shows that upon entry on active duty in the U.S. Army, the applicant's last name was correctly recorded in his military service record. The evidence of record also shows the applicant's name was correctly recorded in his official military service records, except on the orders and DD Form 214 that were issued based on his retirement from active duty, and on the DD Form 215 that was subsequently issued to correct his DD Form 214. As a result, the Board recommends that...

A DD Form 215 (Correction to DD Form 214), dated 12 December 2006, contained in his record shows the spelling of his last name was corrected to show "Santiago." Evidence of record shows an error was made on his DD Form 214 because he could not be credited with 2 years, 7 months, and 8 days of active service if he entered AD on 3 April 1969 and was separated on 10 November 1970. As a result, the Board recommends that all Department of the Army records of the individual concerned be...
