IN THE CASE OF:
BOARD DATE: 2 December 2014
DOCKET NUMBER: AR20140007012
THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his social security number (SSN) as XX6-XX-XXX6, versus XX0-XX-XXX5.
2. The applicant states his SSN is XX6-XX-XXX6, not XX0-XX-XXX5 as shown on his DD Form 214.
3. The applicant provides his DD Form 214, his DD Form 256A (Honorable Discharge Certificate), and a copy of his social security card.
CONSIDERATION OF EVIDENCE:
1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to
timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.
2. The applicant's complete military records are not available for review. A fire destroyed approximately 18 million service members records at the National Personnel Records Center (NPRC) in 1973. It is believed that the applicant's records were lost or destroyed in that fire. However, the documents provided by the applicant offer sufficient information to conduct a fair and impartial review of this case.
3. According to the DD Form 214, the applicant enlisted in the Regular Army on
10 September 1968.
4. On 13 June 1971, he was honorably released from active duty. His DD Form 214 shows his SSN as "XX0-XX-XXX5."
5. He provides a copy of his social security card and his Honorable Discharge Certificate, both of which show his SSN as "XX6-XX-XXX6."
DISCUSSION AND CONCLUSIONS:
The evidence indicates an administrative error was made when recording the applicant's SSN on his DD Form 214. Therefore, It would be appropriate to correct this error at this time.
BOARD VOTE:
____X___ ____X___ ____X___ GRANT FULL RELIEF
________ ________ ________ GRANT PARTIAL RELIEF
________ ________ ________ GRANT FORMAL HEARING
________ ________ ________ DENY APPLICATION
BOARD DETERMINATION/RECOMMENDATION:
The Board determined the evidence presented is sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by
amending his DD Form 214 to show his SSN as shown on his social security card.

The applicant requests correction of his DD Form 214 (Armed Forces of the Unites States Report of Transfer or Discharge) to show his Social Security Number (SSN) as xx0-xx-xxxx instead of xx3-xx-xxxx. Application for correction of military records (with supporting documents provided, if any). Item 3 (SSN) of his DD Form 214 shows his SSN as xxx-xx-xxx8. However, his DD Form 214 is the only document the shows his SSN as xxx-xx-xxx8.
ARMY | BCMR | CY2011 | 20110024781
The applicants DD Form 214 shows he was honorably released from active duty on 18 January 1985. The evidence of record shows his SSN appeared as xx3-34-xxx9 on all documents in his Official Military Personnel File (OMPF) during his period of military service. Based on his SSN card, his SSN is xx6-23-xxx5, however, it is not the SSN he used when he served on active duty, and this does not change the conditions and circumstances that existed at the time his service records were created.
