THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests correction of her DD Form 214 (Certificate of Release or Discharge from Active Duty) to show she was awarded or authorized the Iraq Campaign Medal and the Overseas Service Ribbon.
2. The applicant states that the awards will verify she served her country in Iraq. Her deployment to Iraq is listed in item 18 (Remarks) of her DD Form 214.
3. The applicant provides a copy of her DD Form 214.
CONSIDERATION OF EVIDENCE:
1. The applicant enlisted in the Minnesota Army National Guard on 25 September 2002. She held military occupational specialty 91E (Dental Specialist).
2. She entered active duty in support of Operation Iraqi Freedom on 16 January 2004 for a period not to exceed 730 days.
3. According to the Defense Finance and Accounting Service (DFAS), her Master Military Pay Account (MMPA) shows she received hostile fire/imminent danger pay for service in Kuwait from 25 February 2004 through 22 February 2005, a period of 11 months and 27 days.
3. She was honorably released from active duty on 22 February 2005 as a private first class/E-3 after completing 1 year, 1 month, and 7 days of net active service. Her DD Form 214 shows in:
a. Item 13 (Decorations, Medals, Badges, Citations, and Campaign Ribbons Awarded or Authorized), the Army Commendation Medal, National Defense Service Medal, Global War on Terrorism Expeditionary Medal (GWOTEM), Global War on Terrorism Service Medal, Armed Forces Reserve Medal with M Device, and the Army Service Ribbon.
b. item 18 (Remarks), in part, "SOLDIER SERVED IN IMMINENT DANGER AREA IN IRAQ FROM 20040223 TO 20041229."
4. Army Regulation 600-8-22 (Military Awards) provides that:
a. The Iraq Campaign Medal is awarded to members who have served in direct support of Operation Iraqi Freedom (OIF). The area of eligibility encompasses all the land area of the country of Iraq, the contiguous water area out to 12 nautical miles, and all air spaces above the land area of Iraq and above the contiguous water area out to 12 nautical miles. The Iraq Campaign Medal period of eligibility is on or after 19 March 2003 through 31 December 2011. A bronze service star is authorized for wear with this medal for participation in each credited campaign. During her service in Iraq she participated in the following two named campaigns: Transition of Iraq (2 May 2003-28 June 2004) and Iraqi Governance (29 June 2004-15 December 2005).
b. Service members qualified for the GWOTEM by reason of service between 19 March 2003 and 28 February 2005, in an area for which the Iraq Campaign Medal was subsequently authorized, will remain qualified for that medal. Upon application, any such service member may be awarded the Iraq Campaign Medal in lieu of the GWOTEM for such service. No service member will be entitled to both medals for the same act, achievement, or period of service.
c. The Overseas Service Ribbon is awarded for successful completion of overseas tours. According to the Awards Branch at U.S. Army Human Resources Command, Iraq and Afghanistan are considered isolated areas where tour lengths have not been established by the Department of Defense. Soldiers who serve 11 cumulative months in a 24-month period or 9 months continuous in Iraq or Afghanistan get credit for a completed short tour.
DISCUSSION AND CONCLUSIONS:
1. The available evidence shows she was deployed to Kuwait/Iraq from
25 February 2004 to 22 February 2005, a period of 10 months and 7 days. Therefore, she served a qualifying period for award of the Overseas Service Ribbon. Her DD Form 214 should be corrected to show the award.
2. Although her service in Iraq qualifies her for award of the Iraq Campaign Medal with two bronze service stars her records show she has been awarded the GWOTEM for her service in Iraq. No service member will be entitled to both medals for the same act, achievement, or period of service. Since she did not specifically request the Iraq Campaign Medal in lieu of the GWOTEM, her DD Form 214 should not be corrected to show she was awarded or is authorized the Iraq Campaign Medal.
3. The applicant has the option to request award of the Iraq Campaign Medal with two bronze service stars in lieu of the GWOTEM.

BOARD DETERMINATION/RECOMMENDATION:
1. The Board determined the evidence presented is sufficient to warrant a recommendation for partial relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by adding the Overseas Service Ribbon to item 13 of her DD Form 214.
2. The Board further determined that the evidence presented was insufficient to warrant a portion of the requested relief. As a result, the Board recommends
denial of so much of the application that pertains to correcting her DD Form 214 to show she was awarded the Iraq Campaign Medal.
