THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests that his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) be corrected to show his correct Social Security Number (SSN) and Home of Record (HOR).

2.  The applicant states his SSN and HOR on his DD Form 214 is incorrect.  His SSN should be the same as is reflected on his Social Security Card, and his HOR should reflect Granite City, Illinois instead of Granite City, Missouri. 

3.  The applicant provides copies of his DD Form 214 and Social Security Card.

CONSIDERATION OF EVIDENCE:

1.  Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice.  This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so.  While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file.  In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.

2.  The applicant enlisted in the Regular Army on 15 January 1968 for a period of 2 years.  At the time of his enlistment his records were prepared to reflect the SSN that is reflected on his Social Security Card and his HOR was recorded as Granite City, Illinois.

3.  The applicant was discharged on 29 December 1968.

4.  The DD Form 214 issued at the time of his discharge shows his SSN as being other than the SSN recorded in his records or on his Social Security Card and his HOR was entered as Granite City, Missouri instead of Granite City, Illinois.

5.  On 9 February 1976, the applicant submitted a request to have his SSN corrected on his DD Form 214 and on 31 August 1976, a DD Form 215 was issued to make that correction.  Accordingly, the issue of his SSN will not be discussed further in these proceedings.  A copy of the DD Form 215 will be provided to him.

DISCUSSION AND CONCLUSIONS:

1.  The applicant’s HOR is incorrectly reflected on his DD Form 214 as Granite City, Missouri and should reflect a HOR of Granite City, Illinois.

2.  Accordingly, his DD Form 214 should be corrected at this time to reflect his HOR as Granite City, Illinois.
