THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his social security number (SSN) as x97-xx-xxxx instead of x79-xx-xxxx.
2. The applicant states the SSN on his DD Form 214 is wrong.
3. The applicant provides his DD Form 214, social security card, and State of Ohio Driver License.
CONSIDERATION OF EVIDENCE:
1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.
2. The applicant enlisted in the Army National Guard (ARNG) on 28 November 1966. Upon his enlistment, he was assigned a Service Number.
3. He was ordered to active duty on 14 February 1967. He served 4 months and
7 days on active duty and was honorably released on 20 June 1967. Item 3 (SSN) of his DD Form 214 shows his SSN as x79-xx-xxxx.
4. He was honorably discharged from the ARNG on 27 November 1972.
5. There are only two documents in his record that contain an SSN. These documents include his National Guard Bureau (NGB) Form 22 (Report of Separation and Record of Service in the ARNG of Ohio and as a Reserve of the Army) and a document from the United Parcel Service (UPS), dated 19 May 1969. These documents show his SSN as x97-xx-xxxx.
6. His social security card shows his SSN as x97-xx-xxxx.
7. Army Regulation 635-5 (Separation Documents) at the time stated the DD Form 214 is a summary of a Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of active duty service at the time of release from active duty, retirement, or discharge.
DISCUSSION AND CONCLUSIONS:
It appears his service number was used throughout his period of enlisted service; however, his NGB Form 22, a document from the UPS, and his social security card confirm his SSN as x97-xx-xxxx. Therefore, he is entitled to correction of his DD Form 214 to show this SSN.
