THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in effect, retroactive award of Non-Physician Board Certification Pay (NPBCP) from 13 July 2011 through 10 February 2013.

2.  The applicant states he has not received NPBCP as an entitlement since his entry into the U.S. Army.  He has been board certified as a Family Nurse Practitioner since 16 December 2009 which was prior to his entering active duty on 13 July 2011.  He was not aware of the process for obtaining entitlement for NPBCP until recently.

3.  The applicant provides copies of his Officer Record Brief, Family Nurse Practitioner Board Certificate, and a DA Form 4187 (Personnel Action).

CONSIDERATION OF EVIDENCE:

1.  The applicant was commissioned in the Regular Army, Army Nurse Corps, as a captain on 13 July 2011, with prior commissioned service.  He provided copies of the following:

* Family Nurse Practitioner Board Certificate valid from 16 December 2009 through 15 December 2014
* DA Form 4187, dated 3 February 2014, wherein he requested NPBCP with an effective pay date of 4 October 2011

2.  In an advisory opinion, dated 3 April 2014, the Chief, Army Medical Department (AMEDD) Special Pay Branch, stated:
   a.  Requests for NPBCP are initiated by the officer through their supporting human resource office.  A review of supporting documentation and available special pay and finance data indicated the applicant's NPBCP was started on 11 February 2013 with a current expiration date of 15 December 2014.  There is no record of submission, authorization, or payment of NPBCP for the period of board certification commencing on 13 July 2011 through 10 February 2013.

   b.  The applicant is eligible to receive NPBCP for the 19-month period of 13 July 2011 through 10 February 2013.  The Defense Finance and Accounting Service would need to pay the retroactive period utilizing a Health Professions Pay Entry Date or finance MS-Pay-Date of 13 July 2011 for the correct monthly pay rate level.  The retroactive payment for that total period is approximately $3,150.00 prior to withholding; exact payment to be determined by DFAS.

3.  On 3 April 2014, the advisory opinion was forwarded to the applicant for acknowledgment and comment.  In his response the applicant stated he concurred with the retroactive payment for the NPBCP for the 19-month period of 13 July 2011 through 10 February 2013.

DISCUSSION AND CONCLUSIONS:

1.  The evidence shows the applicant was fully eligible for the requested NPBCP from 13 July 2011 through 10 February 2013.  

2.  In view of the foregoing, he is entitled to payment of NPBCP from 13 July 2011 through 10 February 2013.
